question regarding I-130:

Got a question for you guys, before I file my i-130 I just like to know if our case stands any chance to be successful,


we were introduced by a family friend in 2011, I went to china to see her in 2012, she came to U.S twice in 2012 to visit me, and we were engaged in Oct. 2012. She came over for chinese new year this year and we picked up or marriage certificate.


She went to college in the states and she was maid of honor for one of her best friends, so she came back with me when I visited her in May. And of course, she was sent back from the airport because we are married and she can't prove strong ties back to her home country. The CBP officer who sent her back adviced me to do i-130 petition to get her back to the states, and he give her an option to withdrew the visitor visa.


I am wondering do I have a realistic chance to get her back in the country?

Denied at border by CBP has no reflection on your I-130 petition. Unless she lied or misrep. many of us have had this happen.

You have many visits (well her to you) have you been to China at all?

I will let the people married to people from China chime in. I know the embassy there is no joke.

That was not me, our questions are very different. The person from Tianjin went back because she doesn't want to over stay her visa. In my case, my wife was sent back because she was married to me and she can't prove she will be back after her friend's wedding.

but the OP has 'moved along' with casefile processing, submitting stuff into NVC at the moment.

Apologies - I was a bit muddled.

Have a read, included what I wrote there. IMO, if you cover this stuff in an EOR, submitted with the I-130, you'll be (she'll be, rather) ok.
