Travelling to US after submission

Timeline

I am Canadian and am about to submit my I-29 for the K-1 Petition but I have a trip planned for August and now I am getting worried about getting denied at the border. Does it show up when they scan your passport, do they know that you've filed a petition?

Now I'm thinking it may be easier to just get married and file after... ahh please advise!!!

No but having that NOA1 actually helps prove you're doing things legally. Do you live closer to Montreal or Vancouver?

Bring copies of yany tides to Canada to show that you will not immigrant to the U.S. Includes Leases, Mortagages, Car loan, School Records, and Employment letter. This can guarantee you that you do not have plans to move to the u.S. then again the border patrol have the final say when you crossin g the border. My wife now, never had any issues crossing the border while immigration was pending when she provided her tides to Canada.

I never had any problems getting across the boarder to visit my fiancé during the K1 process. Approximately six visits during that time. Most visits were for one week.

But taking documents with you 'just in case' is always a good idea. Especially if your visit will be for longer than 2 weeks.

There are lots of factors that go into deciding the K-1 route or the CR-1 route. I’m not sure if you have seen the comparison chart: http://www.visajourney.com/content/compare

Now is the perfect time (prior to filing) for you both to decide the best route - it sounds in your post like you’re not set on the K-1 route yet.

A couple of things to keep in mind: As a K-1 you get married in the US and apply for EAD, AP and AOS. Until the EAD and AP come through you cannot collect EI from Canada (you would apply right away though), you cannot work and you cannot travel outside of the US. If there is an emergency at home, you must make an InfoPass appointment to try for Emergency AP and hope they’ll give it to you.

If finances are a concern with you CR-1 may be the better route. It's cheaper in the first place and you get the green card right away on POE. This means you can collect EI from Canada or if you find a job right away then you can work.

If there are issues with your parents’ health or you have weddings or other family/friend functions that you will want to go back in Canada, CR-1 may again be the better bet for you.

That aside, I have travelled to the US many times while we were dating, engaged and married. Just be honest and carry proof of ties to Canada.

That's a great link! Thanks! :) IT seems like with all the visas you will need the same amount of proof to show ties to your home country.

Same potential issue. If you get married and then try to visit the US without a spousal visa; I'd venture there's more reason to deny you because you'd really have a reason to want to stay in the US.

Follow the process like everyone else and all will be OK.

As a Canadian spouse of a USC, I had no issues going to visit my husband during the process and vice versa. Most Canadians don’t normally have any problems whatsoever.

Just bring proof of ties whichever route you decide to go with.
