Responding to RFE, enough evidence?

I'm responding to an RFE, I hope to send this evidence out before the weekend. Deadline is July 12.

On the RFE, it lists that I have already given them the following items:

-identification documents

-an IRS tax transcript (I sent several years)

-acquaintance affidavits

-insurance documentation

-account invoices

-bank statements

-phone bills

-travel itineraries

-greeting cards

-photographs.

They said we need to submit evidence establishing a GOOD FAITH MARRIAGE and requested the following:

1. Children as proof. (unfortunately she miscarried the 1st and just recently lost the 2nd shortly after birth) We do not have a birth certificate yet.Should I send hospital docs?

2. Evidence that you and your spouse resided together

*I will send the Deed to our home.

3. Evidence that you and your spouse have combined financial responsibility, joint assets

*I will send again joint checking/saving accounts, joint credit card, joint insurance (medical, auto, home, life, etc), joint Fed and State taxes, joint ultiity bill

4. Evidence that you and your spouse have estate, health and financial arrangements

*We don't have a will, or trust. Will this be an issue? She is 100% beneficiary on my Life ins.

5. Affidavits from third parties who have knowledge of a bonafide relationship.

* We sent 2 affidavits with the original submission. Should I resend them or get 2 new affidavits from other people?

I'm surprised you got an RFE. Beside the deed (and maybe joint car insurance/ownership), I thought your evidence would have been considered pretty good.

05/31/16 - Was denied walk-in fingerprints with just 1 person left in line. Milwaukee office, boo! - Day 21

06/07/16 - Biometrics completed in Milwaukee, WI - Day 28

12/21/16 - Passed Citizenship test/Interview was successful! - Day 197

01/26/17 - I am a US citizen!!! - Day 233

That's weird, that you've got an RFE, your application seem pretty "complete".

We sent almost the same documents that you did, but we don't have/want kids. So now I'll expect to receive an RFE because we don't have children...That is ridiculous!:D

You've sent 2 affidavits and they asked for more? I thought they don't care about affidavits in the first place. I've also included just 2 in my application.

Oh well, if we get an RFE with some ridiculous demands, we'll just go to a lawyer.

In your case, seems you got that RFE just because someone had a crappy coffee in the morning or a bad day and really wanted to ruin someone else's day.

RFE is not a big deal. Sometimes a good applications do get RFEs and a few not so loaded ones get approved just like that.

Yes it is very important for us, who are the recipients, but for the guy who is reviewing it is a routine thing. Not all our figures are equal and so are those reviewers, so it light.

There is no need to go to lawyer and waste your money. Just send the documents asked for in time and that should do for almost 90% of the cases. The worst case is an interview, which is also not bad except that it causes inconvenience but as long as the marriage is genuine everyone got through the interviews pretty well.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Yeah, you're totally right, specially about the lawyer. We had a lawyer for the AOS and dealing with him was soooooooo frustrating! He didn't even come for our AOS interview, he sent some young bozzo who was late (and useless) so we lost our place in line.

My husband wanted to go to him again, for the I-751 application but I said " There's no way I'm going to that jerk again, I rather donate those money for charity" :D

I don't know what else can I send if I get an RFE, I've sent pretty much everything, from house deed, car title+insurance, joint taxes, joint bank accounts, 401k, life insurance, medical insurance, utility bills, affidavits and so on..

Yeah, I'm a very stressed person, sorryoops8rh.gif . You don't want to see me taking my pets to the vet when they're sick blush.png

I sent off the packet in response to the RFE today. I provided exactly what they asked for and more. I hope to hear back soon.

As a matter of fact my case looks like your case I received RFE last week, but the only thing wrong was to send the last six month of the bank account so I replied with 2 years of shard bank account and car insurance that proofs we been on same policy for 2 years.

Ps. I just got approved today, so just 7 days after I responded to the RFE

What a pain in the butt. Everything looks good! Just resend the stuff they requested and add the additional stuff.

Include the life insurance as well :)

Thought to the General Air: It mystifies me why so few folks submit Wills, Medical Powers of Attorney, and similar as evidence. Such items are among the most solid proof of all! In addition, they're crucial to have, immigration requirements aside.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
