Hello Everyone. My mother (GC holder since 2009, housewife in India) applied for my brother (currently unmarried, 30) the same year under F2B category. My mother doesn't live in USA and visits america every year for 2 to 3 months. As she is the petitioner she need to provide Affidavit of Support to USCIS. My mother never paid any taxes in US and has no ties with USA. As her daughter I could be a joint sponser but is there any way she could provide affidavit of support when the priority date will become current.

Additionaly, I read somewhere she need to show that her domicile is in USA not abroad. How can she show her domicile in US while living abroad? She went back to home country because of my grand parents. Please help.

I'm not sure how your mother is going to prove she lives in the USA when she doesn't live in the USA. She's rather fortunate that her green card hasn't been taken away at this point.

+1 post above. Her domicile is not in the USA. It sounds like you're asking us how she can pretend it is. This forum doesn't support fraud.

This is an explanation of domicile from the department of state website (and how one might go about re-establishing domicile): http://travel.state.gov/visa/immigrants/info/info_3183.html#3

3 months in USA

9 months in India

No taxes

Green card is for living permanently in the US, not for visiting purposes. Better fix that now or your brother will lose his chance of immigrating.
