Timeline

Good morning my peeps!!! I need help because I'm losing my mind.. After my fiancé got here from Haiti .. It's been three weeks now.. He got a call from Haiti that his dad became ill.. Since then he's been miserable... I didn't want to be the ungrateful fiancé knowing how much he loves his dad.. we decided he has to be there for his dad...he has his social security already but we didn't got married.. Over the weekend he decided he wants to go back to Haiti . So this morning he left... What is going to happen? What do I need to do? Help me please? Is he able to come back here at all ? Any suggestions will help

There is an exception if you didn't get married. It is possible to have your K-1 visa reinstated (it will be for the original time) and he could come back and you could marry like he never left. You say he was in the US for 3 weeks so you've got about 2 months left. Contact the embassy.

Harpa is right- there is a chance they wil re-issue the visa, but with the same dates. So that is an option if he will only stay abroad for a few weeks

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes I believe you pay the visa fee again. Paltry compared to the cost of flights and the AOS, though.

Hoping things work out...let him get death notices/announcements, funeral program

,receipts for any spending towards funeral & I think he will get good consideration

based on this matter, I'd also contact my congressperson to see if they could offer

9 FAM 41.81 N6.3 Reissuance of K-1 Visa(TL:VISA-2; 08-30-1987)If a K-1 visa, valid for a single entry and a 6-month period, has already been used for admission into the United States and the alien fiancé(e) has returned abroad prior to the marriage, the consular officer may issue a new K visa, provided that the period of validity does not exceed the 90th day after the date of initial admission of the alien on the original K visa and provided also that the petitioner and beneficiary still intend and are free to marry. The alien’s return to the United States and marriage to the petitioner must take place within 90 days from the date of the original admission into the United States in K status.

I went through this reissuance of K-1 Visa before.

- Contact the US consulate in Haiti for advice, to see if they will reissue the K-1 Visa.

- You have to resubmit all the paperwork (I-134), new medical checkup, new police record according to the K-1 visa checklist.

- Schedule the interview and pay all the fees again.

All these must happen before the 90th day from the 1st date of entry to US.
