Hey guys my fiancé arrived on Sunday POE JFK and the immigration officer took his i-94 away and said that k-1 visa holders don't need it. Now I'm looking through the requirement to apply for a Ssn and I see that the I-94 is required. My question is, is this really necessary or can He just go without the I-94.?

The I-94 was required when my wife entered in 2012, as well as we entered on her parole document later in 2012. They never took it from her. I would double check, as they should've left one part in the passport.

You ned to go back to the airport and get a I-94. It is required. The POE officer made a mistake.

(I am guessing your fiance filled one out on the plane and the officer took it and threw it away saying it wasn't needed. Is that what happened? It;s sort of confusing when you say the officer took it.)

Is this part of the "new and improved" CBP electronic I-94 process that is being implemented?

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

  • 2 weeks later...

I just found this on the U.S. Customs and Border Protection

Will Customs and Border Protection (CBP) still issue paper I-94 Forms to travelers once the I-94 Automation begins?

No, not for air and sea travel. Rather than distributing a paper Form I-94, Customs and Border Protection (CBP) will scan a traveler's passport, generating an electronic arrival record with data elements found on the current paper Form I-94. CBP will make the electronic I-94 available on the website. Travelers may wish to visit the www.cbp.gov/i94 and print their electronic number before applying for immigration or public benefits, such as driver's licenses or social security numbers.

CBP intends to continue to provide a paper Form I-94 to certain classes of aliens, such as refugees, certain asylees and parolees, and whenever CBP determines the issuance of a paper form is appropriate.

For more information on the I-94 automation process, visit CBP.gov.
