102 form and AOS

Hi guys,

came in as a student back in 07. and married my lovely wife three months ago after courting for two years.

i am putting together the paperwork for my aos package.

I lost my i-94 card but i know my 94 number, date of entry, point of entry etc.

Would i still need to file the i-102 for a replacement since i already have the information on the card.? Can i provide other forms of proof like the stamp on my visa and passport and so on? it feels like the $330 is not necessary since i have all the information on it.

If there is no way around it, can i file it together with the aos package? how do i go about that.?

i dont want to have to wait for another three months or so for that to come through.

I am trying to get this over with as soon as possible so i can start to work and provide for my family.

PS i have tried going back to my school to check for records, but they do not have it.

Moved from adjustment of status from family based visas to adjustment of status from work student tourist as the OP did not enter on a family based visa, they entered on a student visa.

You can submit a copy of your passport stamp from entry and hope that that will be sufficient proof.

Sometimes they will RFE you for proof of legal entry even when you have submitted that. At that point you could either resubmit what you have submitted previously, perhaps with a cover letter saying "I entered legally at suchandsuch a place and here is my stamped passport proving it", or obtain and submit a new I-94 using an I-102. The time would likely run out on the RFE before the I-102 was processed if you waited, though.

So, while they should accept the passport stamp as proof of legal entry, they do not always do so.

finally..

ive been looking for answers to this specific problem.

i set an infopass appointment with USCIS though.. as EasternDE suggested. I will post what the results of that meeting.

I was at the USCIS office yesterday for an infopass appointment regarding this issue.

The officer said If you can provide other proof of entry like the stamp and other evidences stated in various forums, you would not need to fiile the form I-102.

My case was unique though as i still remember my number. She said the officials would be able to pull it up. When they see your entry stamp and what not.

I hope this helps any one going through this situation in the future.
