i-102 form with AOS

Hello All,

First time poster here.

I am in a peculiar predicament as there are a lot of conflicting solutions to it. Most of the posted solutions are quite old. So i hope someone with the most recent experience will be of help to me.

I recently got married and i am in the process of getting all my paperwork together. Been following the directions of various posters. I found out that i lost my i-94. It must have gone missing due to all the moving ive made over the years. Getting online, i found out that i will need to file the form i-102 to get a replacement, and that will take approx. three months. Too Long.

I was wondering if there is any way around that. Could i, just possibly, file my i-102 with the same package to the same lockbox as my AOS package? That way,everything is done at one place and i can get both my new i-94 around the time my SS and EAD comes through? or i would have to wait the three months.?

i have seen some answers from years ago, but surely there must be ways around that at this time?

Please help. Every response is appreciated.

I94 should be in your passport or old passport if it has been a while. Since you are doing an AOS, you should not need a copy of it BUT you will need to know some of the information that was on it such as number, issue date etc.

that is the problem, i forgot my numbers on it.. i do remember when it was issued though(as that was the day i came into the country)

If you file them at the same time, you run the risk of losing your AOS fees and having to refile if your I-102 isn't processed in time.

Your I-485 will be accepted, but you'll get an RFE pretty quickly for your I-94. If they don't receive your replacement I-94 by the deadline of the RFE, you'll lose your AOS fees and have to refile all over again.

Not to mention that if your I-485 is rejected then you are usually placed in removal proceedings.

you used an F-1 visa to come into the USA? If so, is great possibility that the DSO at your last school has a copy on file.

Thank you all for your responses.

However in Part 3 of the form, it asks if i am filing this with any other application or petition. That seemed like a spot where i can put the other aos package so as to notify them that my 102 is being processed.

does this not apply to me or what?

You can mention it, but since the I-102 must be mailed to a different location then you cannot submit it in the same packet.

Stating that you also have a pending I-102 will not prevent USCIS from RFE'ing you for the missing I-94 on your I-485, which, as mentioned above, could cause you serious issues if you are not able to reply to the RFE in time.

Thank you all for the prompt responses.

i just found out that i wrote my i-94 number on my old passport in a little corner. My wife spotted it written quite legibly too.I suppose my younger self was smart enough to see into the future that i would lose the card.

Would i need to still file the i-102 now? i was thinking i could just enter the number into the forms with other forms of proof of legal entry. With an explanation that the card was lost.

Can that work?

I am just trying to get all the packages out as quickly as possible.

All comments and suggestions are appreciated.

No. If you do not provide a copy of the actual I-94 with your application you will be RFE'd for it, and if you do not provide it with the RFE then your application will be denied.

You need a copy in your hands, not just the number.

There are a lot of conflicting solutions to this problem. It sucks that the USCIS do not have specific way of handling this situation.

I also had this sent to me:

"Do you still have the passport and visa you used when you last entered the US? And do you know the date and place of entry? Does your passport have an entry stamp for that date?

If yes to all questions, you can file the I-485 without the I-94 or I-102. Just include a copy of the identifying pages of your passport, and also a copy of the page with the visa you used to enter the US and the page with the entry stamp."
