9 Months Waiting for AOS (Today RFE)

Why did my application sit in the USCIS Acceptance stage for 9 months and now they are seeking a request for evidence?

Is there a way to looking and see what they are requesting online somehow before the letter comes in the mail?

How long does a RFE usually take to process? How long with this set my case back now?

Early RFEs are when you leave out a basic thing, but the contractors don't go over the fine details toward a decision.

Your case waits a long time to get to an adjudicators desk for approval. The good new is it has made it there. The bad news is he needs something more to approve. When you send it back, your approval could come in maybe 2 weeks or less. It doesnt get back in the long line. There is no way online or by phone to find out what they need. Wait for the letter.

Is there any forum within visa journey that shows example and most frequent RFE for the I-485 forms?

I believe that our package was very complete and everything was fallowed on the instructions. Is it time to get a lawyer involved, should I schedule an interview with one in a week or two when I get the RFE letter? I haven’t had one yet in the whole immigration process but don’t want to make a mistake on the last part of getting the GC approval, and feel I may need a lawyer to help with the RFE?

You don't know what the RFE is yet, so don't get too excited. It could be a simple thing that is easily fixable and sent back the same day.

The most common error is on the I-864. Did you include complete tax forms? Proof of co-sponsors status in the US (passport etc) if using a co-sponsor? Did you include proof of current employment such as an employment letter?

Don't waste too much time asking these questions though. You'll get the letter very soon and then you will know for sure.

The questions is.... before jumping in... What is your RFE (Returned for Further Evidence) for? What do they want from you. Don't make a big deal about it.... just provide what they need. Find out by calling them? or you will just have to wait for the RFE letter to arrive.

Feel better, at least you know your package has not been lost in these past 9 months. Sometimes they need more paperwork... I seen a lot about Birth certificates (Must always send original and a translated in English certified copies), taxes, or person not meeting the 125 poverty percent wage, or not submitting a certified copy of the marriage certificate. Also seen issues when USCIS asks for paperwork that was included in the package, but they apparently lost it.

So... relax... breath a little, and you will need to submit your RFE paperwork as fast as possible to get your case adjudicated.

Now, If you want to waste your money, hire a lawyer... Again, why are you hiring a lawyer for, when you have not said anything of what your RFE is?

AOS Approved 7/5/2013:
308 days (10 months & 8 days) since AOS package was sent
302 days (10 months & 2 days) since NOA1
275 days (9 months & 5 days) since Biometrics taken

The OP doesn't know what the RFE is because s/he has not received the letter yet. You cannot find out by calling anyone. You just have to wait for the letter to come.

I am the only sponser on the I-864, In the insturctions it states you do not need to send your US passport for proof of citizenship if you already completed this in the initial i-129 petition. I know for sure I did not send my passport for proof of citizenship for the I-864 in the AOS packet. Other than that I cannot think of any errors with that form. I am well above the poverty line, I sent 3 years worth of tax returns. I am just not sure.

:wow: You just have to wait for the letter. If you get your nerves worked up, then you will not read and comply with the request appropriately. Just think about it, you now know that it is being worked on and that you will have it soon.
