Hi everyone,

My husband is a USC and is on process to petition my kids (his stepchildren)so they can live with us. I heard that during the interview in the consulate in the foreign county where my kids are, the following are asked;

1. notorized statement of approval from the biological parent consenting to their child being taken to the US to live with the other biological parent.

2. notorized statement of approval from one biological parent giving permission to the minor to leave the country with only one parent.

I would like to ask any help regarding this matter and I would greatly appreciate it. Hoping to read from this post soon. God bless everyone.

We are in the exact same position. I assume you have an issue with reaching or wanting to contact their biological father? I don't have an answer and am currently just entering the NVC process post NOA2.

I do know that during the process of getting them an H visa before our marriage and AOS, she did get through a process of going through DSWD which included statements from neighbors stating he has not been in the children's lives and other documentation. I understand it can be done case by case. They were approved and were able to visit in the US and returned within the window. We have started though the I-130 process now for the kids. I am just hoping we are able to go through that again for the visa interview in Manila.

If you were NEVER married to their bio father, you DON'T need to get his consent/permission in order for your illegitimate children to immigrate.

In the Philippines, illegitimate children are under the sole custody of the mother.

Thanks everyone for the reply. I am married to him in Philippines. The problem is he is not cooperating with the kids documents. He refused to sign.

AM married or WERE married to him????

If you WERE married, how long ago did you get an Annulment? Is he in the children's lives and if not, how long since he stopped? How much contact do you have with him?

In our case, he has never even laid eyes on his youngest child who is now almost 9 and the Annulment was completed about 6 years ago. No support, no contact at all.
