Let me ask you this in return, when was the last time you saw your fiance or finacee?

Sorry to butt in, but I don't think it matters when was the last time they saw each other.

Obviously it hurts being away from your loved one for periods of time, trust me, most of us filing for K-1 have been there

but it wouldn't be fair nor acceptable for the USCIS to accept money just to bump up your case and process it faster.

Just wait it out. If posible, make more trips to your fiance/e's country. Don't worry your time will come. ;)

Everybody should just calm down ;)

Sadly, the USCIS does whatever they want, sometimes they work fast and sometimes they are very slow. Money is never going to make your process faster. We all just have to wait. It's part of this K-1 process and we have to accept it. Obviously, being away from the love of your life is horrible, but if you can't live without your fiance/e, if possible, you can plan more trips to their country.

This whole waiting process shouldn't be the reason for giving up, everybody's time will come. I too sometimes feel lonely, but if you're positive everything will work out for the best.

Nothing worth having in life comes easy! (F)

I disagree with this. I am in LOVE with my fiance and I'm sure that everyone other person on here is as well, and personally I don't have very much extra money at all to be trying to be "first in line" everyone wants to get through this process, not just you.

A senator or congressman is generally contacted when the petition is already outside of normal processing times. They aren't jumping ahead of anyone.

I love a good conspiracy theory. What do you think they're hiding from us?

Of course celebrities and politicians get special treatment. I mean, I doubt John Lennon and Yoko Ono went to a marriage interview.

High Ranking Elected Government people get Pasports titled "Special Passports". You think that's just for fun? No, it's for special treatment.

Also, think of all the Canadian Musicians and Celebrities that become popular and just magically end up in the USA for the rest of their lives. They don't even marry Americans. Avril Lavigne, Alanis Morrissette, (okay, I know this list of Canadian Celebs is embarrassing) Bryan Adams, Wayne Gretsky,Tom Green. None of them even live in Canada anymore.

It's not a conspiracy theory, it's just the way things work. I doubt Brad Pitt and Angelina Jolie did much "Visa Journeying" to adopt their 1,369 children from every area of earth as we know it.

Just wanted to point out to the people that said that adding the expidite fee or increasing the fee on the original application will not necessarily go to new hires. Each governement agency works on a budget, so even if they made x amount of millions from fees, does not mean they keep them and use them as they please.

I think this whole thread was started with a pretty much 'tongue in cheek' attitude. In other words, it wasn't really serious but just an image of how powerless one feels when waiting with no idea of what to expect or how long the wait would be. If there was some definitive time, it would be easier.

For those of you who talk about visiting... I guess if you're on the same continent it is easier and less expensive. From the other side of the planet we are talking, thousands of dollars for a visit. Apart from that, it depends on what sort of leave from work etc. is possible. Again, if you know the timeframe, then you can make those decisions with some certainty.

Each case is different, so don't judge based on your situation - you may be in a more fortunate situation than others.

I think there should be a VIP K1 processing where they can process your K1 within a month for an extra fee. I am sure a lot of us would gladly pay more rather then just wait  Obviously the name would not be VIP but you get my point.

Don't you guys agree?

The idea of a expedite system is more complex then you might think. As while we in the queue are frustratedly waiting the wishing for a fast turnaround, why would the US Government want a faster turn around. As by slowing the process they are effectively managing the numbers of immigrants via the K1 passage. For instance say there are 10000 K1 succesful applicants a year, and that number increases to 20000 the US Government, like a lot of Governments want to limit migration have two ways of reducing that number from 20000 back to 10000. You can either impose a cap, which in the K1 Class would not go down well with US voters, or they can simply and quietly extend the waiting time, and easily justify it to the voting US public as budgetary issues.

If we passover my first point and assume the US Government does not mind how many K1 Applicants there are, then wouldn't and expedite system very quickly become the normal system as almost everybody that could qualify for it would use, thus having a very minimal impact.

While I symphonies with the OP, that in almost all areas of life (especially in the USA) money makes things happen faster. Look at airlines, you pay a little more and you get to board first, or pay even more and sit in a different cabin. Immigration is and should be considered on personal merits, you should never be able to buy your way into a country. A functioning society needs a mixture of social tiers not just the rich enough to get in.

However, the fact remains that whilst in a utopia all application would be equal, as a lot of posters on the discussion want them to be, are applications are not being treated equally. Who here used expedited shipping thus jumping applicants using cheaper slower shipping, who here received RFE's when others with similar applications didn't, who here is applying through an embassy that is known to be more difficult then others.

These are just my thoughts on the matter

I like and also agree you and with Gegel as there should be more scrutiny maybe included are some set VIP rules and criteria. For example to qualify one must have visited his fiancee 3 or more times. This way Gegel is happier on the scrutiny portion at least  . I lived with my wife-to-be as I was there for work so of course I would want the VIP line now that I meet my VIP criteria  . But honestly the wait made us stronger and closer.... Now how is that for spinning it both ways

Selfishness, everyone wants their chance at the right time

its understandable but ppl claiming they cant living without

each other they no life together yet or kids, then the foreign mate

should move to their country.

I agree wholeheartedly. I stick it out with my husband in his country and we wouldn't even consider spending more than 4 months apart. It just wouldn't even be on the table so to speak.

I know, right?

Best solution is to lock down the immigration and put more restrictive rules in place or just allow everyone to AOS like they do in many civilized countries. I don't see why people should be punished with longer wait times and time apart from their spouse because they actually need to plan to move continents. The whole thing is counterintuitive.

A post I made five years ago. The numbers have changed a little, but the logic is the same.http://www.visajourn...ost__p__2602405

"The issue lies within the differences between the State Department and the Department of Homeland Security. If you are a visitor to the USA, you can enter either via a visa or the VWP, depending on the country of your citizenship. For the visa route, the State Dept issues them and, in the vast majority of cases, the DHS 'accepts' them at the POE with the knowledge that the individual is 'visiting' the USA and will 'most likely' depart (although there are some that do not!).

It is very frustrating to see a visitor get a visa issued by the State Dept in a few days (in this case from a country such as Thailand - see link);

http://travel.state....m...;x=102&y=17

and then have a spouse from the same country take six months (in my case) to over a year in recent cases. So the State Department can issue a tourist or business visa (almost 14 million in 2007) and provide preliminary security checks in an acceptable fashion for most non-immigrants. Then additional security checks are done at the POE by DHS. But the State Dept is incapable of doing the same for family based 'non-immigrants'. Why not do the K1-K4's the same way? Another 50,000 entrants added to the 14 MM is insignificant. It would free up time at USCIS for AOS processing.

Some would argue that the visitor is planning to leave and the K visa entrant is planning to stay. Agreed. But the reality is that a far greater number 'visit' the USA and subsequently apply for AOS; for these individuals it is not substantially different from entering on a non-immigrant K visa and applying for AOS.

The majority of AOS filings for spouses are for individuals who entered the USA with no intent to marry and ended up getting married and then filing AOS. Doing a little math from the attached DHS reports:

http://www.dhs.gov/x..._ni_fr_2007.pdf

Table 1

http://www.dhs.gov/x...LPR_FR_2007.pdf

Table 2

In 2007, 274,000 spouses of USC received greencards (Table 2). An additional 103,000 children of USC (must be stepchildren to have filed AOS) also received greencards.

In 2007, 38,500 fiance(e)s and children entered the USA on K-1/K-2 visas. Another 18,500 entered on K-3/K-4 visas. (Table 1).

So 57,000 entered as K-1 to K-4 and 377,000 adjusted status as a spouse or child of a USC. That's only 15% of all spouses/children entering on a K-1 to K-4 visa. Certainly there are a number of individuals that are CR-1/IR-1 and DCF, but if VJ is any indication, that number is fairly low.

So over 75% of family based immigration occurs via VWP (or other entries) followed by marriage and AOS (suggesting K visas are not the most common route to AOS).

The 'red tape' could be significantly reduced without any increased threat to national security (since the State Dept would issue visas within the same guidelines it currently uses) and little impact on immigration fraud. It would simply mean the spouse would be waiting inside the USA instead of their home country. "

If people could pay for"priority" processing, then a great majority of people would jump on that, therefore still creating a lineup. But then what about those who can't pay? The process would suddenly become even longer as everyone would be jumping ahead in front of them

Seriously, can we please stop judging whether someone's opinion is valuable based on how long they ended up waiting? It's ridiculous. Everyone here has the right to feel however they feel whether they waited 3 months or 8.

I suspect this thread is a troll, but:

There is already a fast track system for people who pay more. Its called "getting a good attorney".

I think it is a matter of opinion if it really helps. Of course the lawyers think so :-)

Scott

This is inaccurate. An attorney, even a good one, can't speed up the process for you.
