So our AOS process has been moving along great with my wife just having completed her biometrics appointment two weeks ago when suddenly today we got a letter in the mail that has me scratching my head. It requested that I, the actual citizen, also go in for biometrics. The attached letter said:

"The attached ASC Appointment Notice was sent to the USC/LPR petitioner because system checks indicate that the petition may be subject to review under the Adam Walsh Child Protection and Safety Act of 2006 (AWA). Biometric processing of the petitioner is required in order to determine the applicability of the AWA.

Accordingly, please take biometrics of the USC/LPR petitioner in accord with the standard local procedures.

We greatly appreciate your cooperation in the above".

I have no idea what the Adam Walsh act was so I naturally googled it and saw it's something that applies to sex offenders. The most legal trouble I've gotten into in my life was a speeding ticket 12 years ago and that's not even on my record. I've never been married before and don't have any kids so it can't have anything to do with that. The ONLY thing I can think of is that, while my wife and I wait for my job to start in October and get our own place, we our both living at my mother's house which she happens to use as a licensed daycare. This was the home I grew up in and, per federal law, as soon as I turned 18 (many years ago) I had to be fingerprinted, have a background check done, etc. My best guess is that since we used this address on our forms, the USCIS noticed this fact and are looking into it.

We've fired off an email to our lawyer but I wanted to see if anyone had any insight on this. All the posts I've seen on here about the AWA are in regards to sex offenders and I didn't see anything about people receiving the notice who aren't offenders. Thanks in advance.

It seems more likely you have the same name and age as someone who is bad and they want to fingerprint you to ensure that you are NOT that bad person. Whatever you do , don't ignore the notice.

Considering I have a very unique name, I doubt this. I just checked the National Registry and state registry just to make sure and neither showed anyone having my name.

It might be what you said...that your mom's house is a day care....and they just want a new fingerprint and see if you after so many years of your last fingerprinting (when you were 18) are still a good moral character and have not been sexually abusing those kids...so, I think if I were you I would go have them your fingerprint. Since you're an honest man, this won't hurt you, and at least they will be rest assured not a sex offender is trying to commit some sort of immigration fraud, or kidnap foreign women! :) There are so many crazy people out there, it is actually somewhat reassuring to hear that they check into this from places where people are "living in a day care". :) Good luck with your AOS application! :)

I will. I definitely haven't heard about anyone else going through this situation. Our lawyer got back to us and she said since I don't have any arrests and convictions it's probably due to the daycare thing. Hopefully biometrics will be the extent of this and we don't get any RFE's.

It just seems like something came up on your name. Most likely it was the fact that you were fingerprinted when you were 18 by the FBI because you live in a daycare. But USCIS cant see that, all they see is you were fingerprinted by the FBI a long time ago, so they want to know why- hence the- you could potentially be an Adam Walsh case go for fingerprints again.

So go do them. Theyll come back clean and your case will continue forward uninterrupted.
