Base on 3 years marriage to a USC

Hey, guy's i just wanted to start a new thread base on 3 years marriage to a US citizen . On this thread we will talk about N-400 only, so i will have to submit my N-400 in November 2013 and i want all the filers N-400 for November 2013, to join me on this forum to discuss every single thing, so i want us to be succeed with the N-400.

I already made 3 trips outside of US and in September i will do my fourth trip outside of US but on of trip lasted 6 month's and 23 days, so i am so afraid of that but i will do all my best to provide USCIS with many evidence i can to get my N-400 approve .

I am worried about the 208 days spent outside but like i said i will try all my best to provide USCIS with enough evidence, since i am still married and have a Daughter with my wife and still live together and we file our taxes together and i think i will have a chance. I planning for an other trip in September and i will spend 114 days outside of USA.

I was thinking about hiring an immigration lawyer but since you don't have any criminal history it is not important , it is wasting money if any of you hire a lawyer and you don't have any criminal history. So i am sill waiting for all of your advices and i think we could make impossible things happening at USCIS.

you broke your continuous residence because you left the states more than 6 months, I don't think you can file as before, except if you can proof to the io that you had to stay out for all that long for because of aa health condition or you have school overseas

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received

you broke your continuous residence because you left the states more than 6 months, I don't think you can file as before, except if you can proof to the io that you had to stay out for all that long for because of aa health condition or you have school overseas

Well, the reason i broke it is hat i i am enrolling to Medical School overseas ( Dominican Republic ) and i am planning to get a later from my school to send with my N-400. So, i don't know if it is a good idea but i will do it.

I believe i will have enough proof and evidence to send to USCIS and bring to my interview to show the IO the reason i stayed that long outside of USA.

6 months doesn't always mean it will break your continuous residency, but the total time per year out of the country will be taken into consideration and that will be the reason in combination with the 6 months + one.

Plus since you've been out longer than 6 months. You will now also have to do extra work to prove to the IO you also didn't abandon your GC at that time. It's good you still file taxes and seems the wife and daughter still live in the US which you will need to prove too. Make sure you bring all the details and proof of your school. That will be a big thing in showing that you were maintaining US residency in most cases.

But as for the continuous residency, all these trips in a short period of time makes me believe that you have re-set your clock. Good news is, it seems you should have enough evidence to show the IO that you also didn't abandon your GC while away, which is a lot more important than having your continuous residency reset...

Looking at your timeline it would appear that you have spent almost as long out of the country as you have in the USA. You seem to plan on applying for Citizenship at 2 years 9 months, when you will have spent a third of the time outside the USA. I am not sure how this will be seen by an IO at interview, but to me it does not look as if it will satisfy the residency criteria, regardless of the 6 month + spell outside the USA. Good Luck!

Advised my stepdaughter to not study aboard until she received her US citizenship. Also saved a great effort in trying to get visa's that she needed with her foreign passport.

All this is called planning in advance, she survived postponing that for just another year.

Another minor factor, in particularly if you are planning on staying here, are those credits you are obtaining studying abroad are going to be honored by some university here? Sure checked into that as well, otherwise, you are just wasting your time and money. If you are on the high honor roll, may even obtain a grant to help pay for those expenses for studying abroad. All this stuff with dealing with both the universities and fighting with the USCIS has to work hand in hand.

Ha, she has a great stepdad to help her with this. Wife wonders how she would have turned out if she didn't.

Well, i believe i could make it happen since i could get a letter from the Medical school i enroll overseas and the hospital i was doing rotation for the six months i spent outside of USA. In November 2013 i will have 20 months of living inside of USA, i will do all my best to bring proof with me for my interview and i will submit copies of them with my N-400 too, and i hope the IO will be nice. I file my taxes with my wife, we have cars on our name, we pay rent together and we both spending money for my medical school overseas and i believe the IO will consider my case.

When they look at how long you've been in the US do they look at the continuous amount of months spent in the US or do they look for total time in the US. On one hand I think we're fine on the other I'm not sure especially if it's 'continuous' months spent.

No problem with your case. There is no such thing as "continuous" months spent inside the US as long as you have been inside the US the minimum required time.

You are good with your case, when your early date come to submit N-400, just submit it and you will be a USC >> good luck
