Maybe this question got asked a lot but I cannot seem to find it. If one applies for citizenship based of marriage 3 years, I saw this:

4. Documents referring to you and your spouse:

Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or

Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or

An IRS tax return transcript for the last three years.

Now, does one have to send all 3 items? or IRS tax transcript is enough? I am confused with this piece, it says "OR", not "AND" - am I missing something?

jkelly07, I think you misunderstood my question. I am not questioning of how to obtain tax transcript, but based of what they listed such as bank accounts, lease, mortgage, so on and so forth. In the n400 package, will one only need to include tax transcript as evidence of marriage enough or have to include bank statements, lease, etc.?

Apparently the field office's IO's don't know the legal difference between the words, "and" or "or". Still demanding all of that evidence that you are sharing your ownership and paying bills together.

Wife's IO could count to three for tax transcripts, but apparently wasn't in the country long enough to realize in 2010, the latest joint income and property taxes we could supply was for the year of 2009. Wife also wondered how she passed her English test, but did manage to land a job with the USCIS. Also wondered why we had to translate all of her Spanish documents into English when the USCIS has a Spanish speaking line.

With all the of rest of the stuff, latest documentation was all that was asked. Her IO asked to see our latest bank statements. Those we sent in were already four months old.

Also wondered why we applied the earliest date, she finally received her ten year card just a week before her interview which was the main reason we applied early. would have satisfied her employer and the DMV. As long as you don't have any traffic violations, didn't divorce or remarry, could have waited for the five year and just brought in her green card. Still have to maintain her foreign passport, thanks to the State Department for that.

But closing the books with the USCIS was a wonderful experience.

If anyone comes across this thread. I wanna to let you know that the answer to this post has not proven to be right yet. Some said only tax transcripts will be enough for N400 package, and bring all other evidence to the interview. I don't want to mislead anyone about this thread. Thx

Nick, why your wife got a 10 years gc before the interview? I am confused. And how can you apply early?

The 10 year GC can take a LONG time (it's 7 months for CSC and 9+ months for VSC) and you don't need to wait for it to be approved if you're still married to your USC. You file for USC (N-400) and it forces USCIS to hurry up and process your 10 year GC.

The responses above me are dealing with the interview when you are specifically asking about what to mail.

No. You do NOT have to send all 3 items. You pick one "line" so personally I'll be doing the last one, IRS tax return transcripts. You still need all the other stuff for "proof of relationship" to take to the interview, but you don't need to send all that.

There's a N-400 thread in my signature that I created and the first post has the actual list of "requirements" for anyone else reading :)

It should really be most of the above, and tax transcripts or IRS certfied copies.

Not to MAIL, but to take to interview, yes.

**Edit - if people want to front-load they are more than welcome. I am simply stating the "requirements" per USCIS instructions.
