Not good news for supporters of same sex marriage, at least here in California. If the Court would have refused to consider the matter, city halls all over the state could be performing marriages the same day. Upholding the usually overturned 9th Circuit would have been a victory for civil rights over the tyranny of the majority. Instead, SCOTUS will have an opportunity to possibly further strengthen DOMA, and limit the ability for Federal agencies, and each of the states, to recognize anything other than a heterosexual marriage between a living biological human male and female, one of each.

I don't see the SCOTUS strengthening DOMA or overturning the 9th circuit on Prop 8. I see the SCOTUS standing for marriage equality. This might very well be the next Roe vs. Wade. Or Brown vs. Board of Education. Can't wait to see the RWN squeal next summer.

If SCOTUS would not overturn Prop 8, why would they hear the case? This has the LGBT community in California worried. California courts have upheld Prop 8 as Constitutional. This is the Federal track that most observers think will end the same way under this conservative Robert's Court.

The California case, brought by Supreme Court superstars Ted Olson and David Boies, was designed from the beginning to obtain a bold, revolutionary ruling by the justices declaring gay marriage a constitutional right.

If Olson and Boies -- who famously went head-to-head in the notorious Bush v. Gore case -- win, it could mean that all bans on gay marriage, everywhere in the country, will be overturned. Gay and lesbian people from Beverly Hills to Bangor will finally enjoy an equal right to marry the person they love.

Yet don't count on a game-changing decision too quickly. It's more likely that Olson and Boies' blockbuster will end with a whimper.

I don't think that Justice Kennedy will stand on the wrong side of history on this. Don't see that happening.

What do you care about being a "good Catholic"? Just because you think being gay is "gross", you find it convenient then to latch onto religion?

Ritual Cannibalism and Vampirism okay. Priests having sex with little boys okay. Mature men having sex with each other not okay. WWJD?

On the other hand, I believe it very pertinent that the SCOTUS rules over Prop H8, for the entire case merits it, on the grounds of jurisprudence and civil rights. In any case, when DOMA is repealed, prop H8 will cease to have any validity anyway, and in that, all these appeals are tied together.

However, the ability for Federal agencies and each state to recognize anything other than a marriage between a male and a female, one of each has sailed a long time ago when divorce was legalized. As the law stands today, marriage can be between many males and females. Heck, for some it is even normal to order a bride straight from a catalog!

And that is the only answer. The Government gets out of the Marriage business all together. If two people want to get married in a church and let that church define their marriage, then have at it. The Government would not issue marriage certificates etc. They would just stay out of it.

OR the opportunity to strike down DOMA nationwide. I sincerely hope SCOTUS gets the federal government OUT of defining marriage.
