CR1 Visa On hold? Need Peace of Mind......

Hello all,

This is my first post here on Visa Journey. I'm basically just looking for a peace of mind on my situation, and to hear from anyone who had a similar situation.

In short, I was lucky enough to meet the most amazing woman I know. I am a US citizen, and she live in Ukraine. We decided to marry in Ukraine last year, and then filled for her Visa.

Today, she had her interview at the US Embassy. At the interview everything went very well for her. However, they did not issue her the Visa. Reason being she did not have my W-2 Tax form from the most recent year. She DID however, have my tax return that I recieved directly from my local IRS office. The person interviewing her would not accept this form, and informed her it needed to be the W-2 form.

There is good news though. They took her passport from her, and made figerprints. They informed her that I just need to e-mail my most recent W-2 and everything will be OK. I know from experience that they place the Visa in her passport, so them keeping this document is a very good sign. I also was able to e-mail the embassy my 2011 W-2 within an hour after she gave me this news.

I called my atrorney and he was confussed why they did this, but it happened and we need to deal with it. I am just curious if I should be worried for any reason, and if this has hapened to anyone, what was there experience. We both have been VERY patient, and was hoping to spend Christmas together. I do not see this happening, but anything anyone can say to put my mind at ease would be great!

July of 2010: We met in Eritrean when I was on vacation.

August of 2010: Returned to U.S and we spoke on the phone everyday and still do (very costly).

December of 2010 to January 2011: went back to Eritrea to see him.

January 11, 2011- Engaged.

March 2, 2011: I-129F sent

March 13, 2012: Second interview. Placed on Administrative Processing.

October 16, 2012: Case sent back to USCIS

November 16, 2012 Case reaffirmed and sent back to the Department of State (according to the USCIS SITE)

November 28, 2012 Vermont Service Center received Petition back from Embassy.

March 2013- Returned K1 validity expired. Here we go again.... !

I-130

March 15, 2013 Married

April 29, 2013 Filed I-130

May 2, 2013: Received NOA1 via text/email

May 6, 2013: Received NOA1 hardcopy in mail

XX- XX, 2013: Received NOA2 via text/email!!!

XX- XX, 2013: Received NOA2 hardcopy in mail

XX- X, 2013: NVC received file

XX- X, 2013: NVC case number assigned

07/31/2012 - Case arrived at NVC (36 Days from USCIS to NVC)

08/16/2012 - Received case #, IIN, gave e-mail addresses

08/18/2012 - E-mailed DS-3032

08/23/2012 - AOS bill invoiced & PAID

08/27/2012 - AOS bill appears as PAID

08/24/2012 - AOS Package sent

08/XX/2012 - AOS/I-864 accepted

08/23/2012 - DS-3032 accepted

08/28/2012 - IV bill invoiced & PAID

08/30/2012 - IV bill appears as PAID

08/28/2012 - IV Package sent

09/07/2012 - REF Forgot bar code cover sheet in AOS packet

09/08/2012 - Mailed REF will be there Monday Sept.10th

09/25/2012 - Case Complete

10/30/2012 - Medical in Kyiv....All good

11/27/2012 - Interview date

In AP.

01/15/2013- Call from Emb####

02/20/2013 -Denied

04/18/2013- Application sent to State Department.

08/23/2013- Talked to USCIS the application is back at USCIS and "might" review it by December.....

08/23/2013- Pissed off.

03/14/2014- Recivied notice from USCIS. Reply due 04/16/14

04/12/2014- Reply mailed 300+ pages.

04/23/2014- Reply from USCIS they received the packet.

07/07/2014- Called my Congressman to check on progress.

07/08/2014- Got a call back from Congressman aid "USCIS is working on it".

07/09/2014- Got email from USCIS that my address change had gone through. I never requested an address change. Call Congressman and USCIS. Was an error an no address change...

07/10/2014- Received email from USCIS. We are approved again. I think the call to my Congressman helped.

08/04/2014- Application received from USCIS and forwarded to Kyiv.

08/19/2014- Interview Sept.19,2014

09/19/2014- Interview Approved.

The free tax transcripts from the IRS (can be faxed to you for free) are free and cost nothing and totally trump any tax returns and missing documents since they are the official statements from the IRS and they are free.

Get your free transcripts now and email those to her to take to the Embassy. They will like those better than a W-2 form. And they are free.

Come to the regional forum, Russia, Ukraine and Belarus (the RUB) and get acquainted with other members who have all similar experiences. You will get good answers concerning what to expect once she arrives and how to avoid some difficulties.

Congratulations, I'm sure she will be flying to you very soon. :dance: :dance:

i say go back to that IRS office, and ask for tax transcript.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
