hi, i am holding a green card. it expired in June this year. i filed I-90 to renew it when i was in US.

the USCIS offise in USA gave me 9 months extension after filing form I-90. so it will expire 9 months after June this year, which is March next year...

recently I withdrew the application due to some family matters. but things went well... and i decided to keep the green card...

so i want to renew it by filing I-90 again. I know I need to start over.

I am in china now. I called USCIS last nite and she said i can still file the I-90 online, she said when i receive the letter of appointment for taking biometric from USCIS, then come back to US and show custom the letter, then they will let me in...

so my question is:

1) is my 9 months extension still valid after i withdrew the application last time?

2) can i really come back to take biometric by showing the letter from USCIS to custom?

**** Moving from AOS to General Immigrantion ****

Was this a 2 year conditional greencard you had to remove conditions on, or a regular ten year greencard?

How long have you been out/ do you plan to stay out of the USA?

it is a regular green card, not conditional green card. i am holding it for over 10 years. i am planning to come back to US for good and become US citizen later.

so my question is:

1) is my 9 months extension still valid after i withdrew the application last time?

2) can i really come back to US to take biometric by showing the letter from USCIS to custom?

I don't think it's legal to file I-90 while abroad, except through the local embassy.

If it's a 10 year card, then all that expires after 10 years is the card, not your status. So ultimately if you present yourself at a port of entry and establish that you are a permanent resident (the expired card is a good starting point for evidence of this, if you still have it, as is the biometrics appointment letter) and that you have not abandoned your status, then you will be let in.

Your problem may be in convincing the airline to carry you to the US without standard documentation. I'm not so sure that the airline will accept a USCIS biometrics appointment letter. You might need a transportation letter from the embassy, which you can get at the same time as you file the I-90.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014
