Hi VJ community,

My wife is in India. Can I ask her to sign and email me a scanned copy of the form G-325a? Did anyone have any problems with this? I am applying for IR-1 / CR1 as a US citizen.

Also what should I write in "Can I get signature of the foreign beneficiary scanned and email it to me?" Should I write "Status as Permanent Resident" or "Other: I-130 form" ?

Thanks,

Gagan

You need to send a copy of G-325A to your wife and she'll fill up that form and sign and send back to you completely through courier. like fedex. If you're applying by email, she can send by scanning the documents to you. Also you need to fill up the I-130 form both of you in 1 page. Also make it 3 copies of G-325A both of you and send to USCIS.

why its need 3 copies of G325A form ? its written that one must be filled by wife and another by husband + passport type pictures, isn't it right ?

i'm filling my I-130 right now and i'm also on that stage right now, but both of us are out of USA and we are going to fill all those forms ( I-130 which will be filled by my american husband only ) G3225A both of us + my husband passports all pages copy + our marriage certificate translated officially by government, send all those forms + document to my husbands family online, they will print add cheque for i-130 payment 420$ and send it to USCIA/

is there more forms which needs to be filled for I-130 package ?

This is wrong.

The form must contain an original signature. A scan of the original is only a copy.

If the wife signs in India, scan , email husband in the US, and husband print out, then husband has a copy because wife still has original in India.

What if my signature is a custom stamp in acrobat.

I stamp it on the acrobat document and print it out.

The original only lies in a digital format on my computer which I obviously can't supply.

No. An original signature comes from your hands. It's a really simple concept - pen and paper.

How did the stamp appear in your computer? Didn't the copy in your computer appear from a physical action? You using your hands?????? Whatever you sign with your hands is an original. Anything printed by a computer is NOT AN ORIGINAL - no matter how it got there; you didn't put pen to paper - the printer put the ink on the paper - so you didn't sign the form - the computer PRINTED a copy of your signature.

How would you sign a PDF of the G-325a? Would you cut and paste your "custom stamp" onto the form? What if I did that with your custom stamp? Would me doing it create an original of your signature? If it does, then I would like to use your custom stamp to create an original signature on some loan applications.

I physically took out my tablet and signed my signature ON the computer, that's what I'm saying.

I signed for my husband with my signature and it was accepted.

And I put "other with I-130"

I saw someone post that they don't really care about the beneficiaries signature on the form.

If that's true, then so be it, but I really have no first hand knowledge.

Here is the USCIS rule on original signatures. If you want to use an electronic signature for a e-filing, then you must use the procedure required by USCIS.

http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=9453d59ae8a8e010VgnVCM1000000ecd190aRCRD&vgnextchannel=fe529c7755cb9010VgnVCM10000045f3d6a1RCRD

Signature Requirements for USCIS Forms

L

Legal Requirements for the Signature on Petitions and Immigration Benefit Applications

Applicants and Petitioners: Applicants and petitioners must sign their respective applications and petitions. The signature must be an original signature. Parents and legal guardians may sign for children under age 14. Legal guardians may sign for individuals who are incompetent to sign. In such cases, the filing must include evidence of parentage or legal guardianship if not otherwise required for the immigration benefit being sought.

Acceptable Signature for E-Filings: Electronic signature rules apply to forms filed electronically in accordance with the instructions on the form.

You sign the screen on the tablet. You didn't sign Form G-325a. The best you can do is merge the two on your computer. That's not an original.

How can it be an original signature if it comes out of a computer printer? You didn't sign the paper. You signed a computer screen.

Technology always runs ahead of big government. You can't use 21st century rules to apply to a 20th century process. There is no difference between a printer and a photocopier.

For paper forms, an original signature comes from your hands with ink to paper. If you print out the completed form and sign it with a pen, then it is from your hands and therefore an original signature. If the computer creates a printout of your signature on the form, then you didn't sign it - the computer printed it on the paper.

Think of it this way. You signed on your tablet. You put it into the G-325a form. You print it out and call it an "original." I make a copy of it. Can you tell me which one is the original and which one is the copy? NO.

If I sign on paper and make a copy, I can tell the two apart. The original will have a signature from a pen. The copy will be PRINTED from my multifunction printer with the same ink as the rest of the form.
