CR1 Package Document Help (China)

Timeline

Recently my wife joined an online group of women that are going through the visa process in her home country of China. At first I thought it would be a good support group for her, however, it has become source of stress for both of us. The group tells her that she will need documents that are not on the list of CR-1 guide or anywhere else I can find. A couple of these documents include 6 months worth of my pay stubs, photo copy of my passport including the Chinese visa, a letter explaining why I am not at the interview, just to name a few. Are these normal things requested by the NVC or is this just bad advice? I want to make sure that we send all they need so we wont have any delay in the process but at the same time I don't want to bog them down with unnecessary documents to slow them down.

Any advice or experience in this matter would be very appreciated.

Darnell has a few choice words about that site.

Anyway, some of the items you speak of are either submitted with the I-130 petition, brought to the interview, or both.

If your most recent pay stub shows your income year to date (most do), then submitting 6 months of pay stubs is not necessary when you submit the Affidavit of Support paperwork to the NVC.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Hi ! Welcome to the 001 BBS Harpies !

Historically, the ones giving advice have had 'alternative' agendas there,

to trip up anyone looking for answers and advice.

It's a game for them.

For bonus points, they win if someone follows their erroneous advice.

OTOH, this is China, Guangzhou IV, the #2 fraud IV post on the planet.

Front-loading the I-130 is a must (usually) as there's extra scrutiny at the IV unit.

But lets assume (based on what you've written) that you've not front-loaded with the I-130 submittal,

or

sent in additional stuff with the document intake at NVC. There is no gaurantee of anything being viewed or asked for on interview day, as each applicant has anywhere from 2 to 20 minutes in front of a bank teller window, for the interview.

You missed two opportunities to get stuff into the casefile, prior to a Visa Officer reviewing the file.

There is another opportunity, but it only lasts for 2 minutes, on interview day,

and that is to 'bring all that you have' for relationship evidence.

Also, GUZ IV is a bit different on evaluating/adjudicating the I-864 (All IV units are the final judge of that form, btw)

as usually one will 'pass' that part for showing 3 years of income tax statements,

and current annual income.

So they mentioned 6 months of pay stubs. Not bad in of itself, to bring those. A current pay stub, or current-ish, showing YTD, is great.

The photocopy of the passport showing your china visa stamps is for relationship evidence - ie - you made the trip to visit her (or more than 1 trip) .

Instead of the letter for 'why you can't be there' - I strongly suggest that you write up an evolution of relationship letter. Here is my sample:

FWIW, none of these 'extra' things are requested by NVC - they use minimal guidelines and GUZ IV uses their own guidelines - so the Harpies at 001 BBS are a bit right on that one point. GUZ IV itself doesn't publish their guidelines - we learn of what works via folk posting about denials, blue slips, 221g documents, here on vj and over at www.candleforlove.com and www.chinafamilyvisa.com and get PROACTIVE based on others' prior experiences.

If you are still at NVC stage - please note that 'adding more' only delays things at NVC by a week to 10 days.

If you are utilising NVC Electronic Processing for document intake, then this delay is minimal and SO WORTH THE EXTRA TIME AND YOUR EFFORT.

Finally, if you have red flags on yer casefile (see http://www.visajourney.com/forums/topic/234971-red-flag-list-for-visa-denial/page__hl__appointment posts 8,9 and 10) then (IMO) you should write up a letter of attestation on each thing, showing additional documentation and evidence on each thing to support each letter of attestation.

The affadavit of support also asks for 'current annual income' which can not be shown by tax returns, all tax returns are 'prior year'

so - what is your plan for showing 'current annual income' ? Don't miss that part, on the I-864 or the I-864 instructions, aye?

Since yer asking about the I-864, I have to assume that yer casefile is still at NVC and that you've maybe just only paid the AOS fee bill.

If you've not enrolled in NVC Electronic Processing, please do so this week by OPTING IN for it.

It'll take some extra time now, but shaves off 1 to 5 months after the casefile has left NVC.

Shift to NVC EP now, and you could be finished by the end of the month, having an interview date in January.

Thanks Darnell,

We just got our approval letter about 2 weeks ago and are now just waiting for them to send the package. However, we did all documents that were listed in the guide for this step before she went back to China. I know once we get the package they will list what they want us to send, so do you have any recommendation besides the evolution of relationship letter and what is listed that we should include?

OK - your I-130 was approved in October.

Congratulations on the fast processing at USCIS-California Service Center - that's always a plus.

You need to call in to NVC , get a human, and jump start the process via telephone.

DO NOT WAIT FOR NVC to send you 'a package'.

This is from the CR-1 guide and where we are in the process - A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC, the NVC will send your relative a packet of forms that you and your relative must fill out before your relative can be given an interview date with a consulate abroad

We have not got the DS-3202 yet so I am just waiting on that before we can do the electronic processing.

Question about the Affidavit of support, I am self employed so I don't don't get a pay stub would a copy of the deposits to my bank account be good enough or do i need to get something from the company that i am contracted to?

So, you've got some studying to do, for NVC intake, aye?
