apply for green card again after I abandon green card

here is my situation. I got married in Hong Kong. my wife is chinese. I am holding my green card for 20 years...

i plan to stay in HK and have a kid, i also need to take care of my parents because they are so old...

I don't wanna keep flying back to US several times a year... can I abandon green card now, and then wait my till my kid become 5 years old, then apply for immigration to US for the whole family?

My concern is... if I apply for conditional green card 5~7 years after i abandon green card, is it much harder to apply again?

I heard that if USCIS will definitely know I used to have a green card, then next time I apply for green card again, it would be much harder.

is that true?

First thing that comes to my mind is to become a US citizen, then stay in Hong Kong until you are ready to return to USA. Becoming a citizen would require a period of residency and some time to process, but may be the easiest option ultimately.

um... i don't prefer that because i will have to separate from my wife and parents for 5 years... i forgot to mention.... one time i didn't fly back to US for over a year... i applied reentry permit....

if i wanna apply for citizenship, i need to stay in US for another 5 years... because the previous 20 years are not counted because i was out of US for over a year.... so i have to start over...

so do u think i can reapply green card? is it harder?

First,

something you may not know. There is the "4 years and 1 day rule" that applies to you. What that means is that the last 364 days of the time you have been outside the U.S. with a reentry permit count. So the day you returned to the U.S. you started with 364 days. The next day you had a full year. So you "only" need 4 more years since that day.

Sure you can apply for a new Green Card if you are eligible, but how did you get your Green Card the first time around? Most likely, there will be years of waiting for you, and I don't see based on what you could get Green Cards for yourself, your wife, and your children this way.

apply new green card by immigration... there is a EB-5 program. investor needs to invest half million in US to apply for immigration. takes only 1.5 ~ 2 years to get conditional green card.

now go back to my question....

if i abandon my green card now, and apply for immigration by investment for myself, my wife and kid 5 years later, is it harder for me to get a conditional green card because i used to have one and and i abandon it?

I already mentioned that I need to abandon my current green card because i plan to have kid in hong Kong. I don't wanna come to US by myself and wait for 4~5 years to become citizen. i just don't wanna separate from my wife...

any advice is appreciated.

No, having abandoned the greencard before won't matter, the USA gladly will take your money again.

There is a small chance that the rules will change (amount of investment goes up etc), and I am not sure how easily it would be to et your family there on that visa.

If you have this type of money then I seriously think you should consult with an attorney. This is an important issue.

Yes most likely you would just have to go through the same process you did to get your original GC (though it was 20 years ago, so things may have changed for the harder).

If you come back to the US a few times a year after moving, you just enter as any other visitor, so don't think there should be any issues there.

If you have been on your GC and haven't abandoned it yet (or more importantly can convince INS that you haven't), then return to the US now and immediately apply for citizenship. Generally it shouldn't take more than a few months to go from sending in the N-400 to citizenship for most people. However, you will have to demonstrate US residency requirements which if you've already moved, that might be hard...

Unless your green-card is terminated for fraud or another major immigration problem it will not be a problem for your EB-5 application.

Re-entry permits are valid for 2 years. I've read that some people have been issued one for two years, come back to the US prior to the expiration and applied for another. Also read the requirements for the SB-1 visa.

I ask, because Taiwan is seconds away from having 'Visa Waiver Program' status, similar to Singapura and France.

you have to attach evidence of ties to the US with that reentry permit though.
