Personally, try this just in case call NVC give them your receipt number just for kicks to see if maybe its there. If not, Than I would call USCIS request a Tier 2 Supervisor and not let them go until you are told specifically where your case is? I mean is it in the building, in a closet, on the road. Do not let them let you off the line until they can tell you something.

You say you have called congressmen and nothing. I would also call them again and again. I find it hard to believe they got nothing after all this time. Are you doing the inquiries or your husband?

It's time to for real make some noise.

ok - some triage.

you've got a receipt number , in the I-797-C formletter, the 'receipt notice' postal mail.

Get an ISO at the Toll Free number listed in the NOA-1, inquire with the ISO:

1. where's the casefile currently?

2. when was the casefile last touched by a human?

3. any returned postal mail pieces ? if so, what are they? RFE? Notice of Approval? also, if so, ask for them to be remailed to the address the petitioner gives the ISO.

4. any returned mail pieces? (stuff to do at home, not with the ISO) print out, on laser printer, all names for the address, tape to the inside of the post box and/or mail slot lid. Then, (this is no joke) bake 2 dozen brownies. Meet up with yer postal carrier face to face, give one set of 12 brownies, introduce yourself. Later in the week, meet up with the postal carrier again (it may be another human), give over the 2nd dozen set of brownies. If the postal carrier says it's not on his/her diet, ask him to take them back to the postal station, give to his co-workers. It's very possible the USPS Postal carrier simply got lazy, or thought 'that name' was not at 'that address'.

Then, report back here when you have more data, as it may be something else has popped up; you'll learn that (rather, the USCitizen Petitioner will) during the phone call.

An ISO can see the same things that a shift supervisor can see, at an InfoPass appointment at a local USCIS office. I have a sinking feeling that yer spouse NOT get someone with God Access at that infopass appointment. Do note the first human you get with the National Hotline is NOT an ISO, that's just a CSR, a Tier-1 subhuman contracted out from SERCO Inc.

Keep at it!!

Now, at some point, starting a service request is useful. IMO, for now, it's not needed. Later perhaps, and soonish perhaps, but not for 'this next round' o contact.

As my knowledge, it takes a month to have a NOA2 after you receive NOA1...Hope and pray that it will come soon to you...Good luck

this is not true...average NOA2 from NOA1 is 5 months

I had the same experience filed august 2011 got NOA1 in august and then nothing. I called uscis over and over again. I even called NVC just to see if the case had been received by them. nothing I just keep calling USCIS and finailly 10 months after filling someone there helped.. Please know I did pay for a lawyer who did nothing here..But the person I spoke with said that the type of visa I was filling me being a US Citizen should have gotten a NOA2 by december 2012 said I only suppose to wait 5 months for this type of visa I was petioning for. She sent a Service Request to the California servicing center and told me I would get some kind of notification within 15 days.. I wrote a letter to my lawyer with the california servicing center email response.. Then 3 weeks later got a RFE.. But a least it's moving now..

Just making sure...you weren't in removal proceedings in the US at any point in the last 2 years, right? Or in general. If you were, that would explain the massive delay and total absence of information. Petitions for people who have been removed within 2 yrs of the marriage get sent into this virtual black hole and some take upwards of 18 months to process. Doesn't sound like this is the case for you since you haven't mentioned it, but your experience sounds identical to those I know who have been in this situation.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

I'm just curious about it. Is there any member here that has the same experience like we had been through right now, especially from fellow Filipinos?

Husband filed I-130 for IR-1/CR-1 last September 2011..It's been almost a year now but no word at all. If you guys want to ask if we did call USCIS, contact Congressman, contact Senator, contact Ombudsman, yes we did but still no to avail.

Mine took 18 months, but I know why. It did move after 7 months. Then RFE's 2x. Lawyer mistakes!

Hello, So you mean that the moment hubby filed the petition last year of September 2011 you did not hear anything? or even the online status in uscis.gov has no progress? I am a September 2011 filer too. They (uscis) received the petition on September 19, 2011 and by march there was a notice that I got denied because of a missing document. Then we appealed to the USCIS and by april 28 I was approved, on May 2 they informed me about it.

I got to ask this.. did your husband the USC really file this or is he just telling you about it? Did you check the USCIS website on your own to keep track of the file? Something tell me this was not filed at all. I really hope that i am wrong.

Yes, you are absolutely WRONG on that. He did file that date he said. He scanned the copy of 2 I-797C and emailed it to me. One I-797C was the acknowledgment of the application fee and the Second one is the notice that our application was transferred. I also have the the original copies of the said I-797C's because my husband brought it with him when he had his vacation here. And of course i checked the USCIS website to check our status since that day i received the I-797C.

So i am pretty sure like 101%...

Transfers between Service Centers result in "lost petitions" at times; going by the statements from a few posters in this forum. There's a chance, IMO, that perhaps the petition was lost in the transition. Why was it transferred from CSC to VSC? Is it because of your location?

Could an RFE (Request for Evidence) been sent to an old address you have and you have not replied to it? But all these would have been reflected on your USCIS #s status on the USCIS web site.

Feed us more information so we can direct you further or at least give you some advise on what action to take. ONE YEAR is just too much!!!And not right...

I really don't know what's the reason of transfer. We were speculating that during that time CSC has lots of backlogs. I am here in Philippines and my husband is in California.

Yes, exactly. ONE YEAR is way beyond processing time. I will really try to understand what is the reason. My husband never changed address. He is still living in the same for 10yrs or so.

Did your husband send you a copy of the NOA1? If not, ask him to scan a copy to you.

Yes, my husband sent me a scanned copy of that I-797C and i even have the original copy 3 months after he received that notice. And by the way, he also sent me a copy of the auto reply from USCIS, Senator's office and from Ombudsman.

I'm also in the camp who thinks your husband might not have sent anything. Ask him for the NOA2.

Thank you so much Amy but i am not that stupid not to check at USCIS website for the status. You mean, my husband might fabricate that WACXXXXXXXX too? Why would i ask my husband for my NOA2?. He ain't no USCIS or NVC and neither a magician.

For everybody's information, we had been together for 6 years, 4 yrs as a live-in partner and 2yrs as married. The reason why it took us too long to get married is because i have to get to know him better. I would never like to be in the states not until, he bought something for me there which i can not discuss. It was just a bad timing that, this time, i am eager to be there and yet i was played by time.
