My only update is I had and went to my biometrics appt here I Austin on November 1st. Sorry for not posting sooner- I got a promotion and have been on alot of planes (in the US only- my passport is expired- waiting on my new unexpired permanent resident card to submit as proof of identity to get a renewed passport. whew- that was a mouthful).

also-I am a wiener---I posted in the wrong year-bwahaha.

So I got to start thinking that somebody at the DMV really screwed up with my license application. 2 years ago, upon presenting my Italian passport and my EAD card, I received a 5-year DL valid until 2015. Obviously I DID NOT state that I was a USC, which was also pretty clear since I was applying showing a foreign passport and an employment authorization card. Am I the only lucky one?

No, you're not lucky one. You just applied for your DL at the right time. I applied for my first DL when I was in high school and was on J2 visa. Then I went off to college, renewing my DL all the time online. Never DMV sent me an actual mail about my status. Then I converted my J2 into F1 when I turned 21, and my DL was valid at that time. Again, as it was expiring I renewed my license as I've done numerous times in the past through online. Now, it will expire in 2015. Since then I have gotten married, have changed my status to that of permanent resident (conditional one). I have not heard a word from DMV since then asking me that "please tell us, are you still on J2? You seem to be over 21!" or "I'm sure you're under a different visa right now, or maybe even a permanent resident, or US citizen, can you show us which one applies to you?" If one is applying for DL at the "right time" meaning not when they just get their GC as a foreign person, then DMV will never ever know what the heck you're doing, and how your status has changed. Obviously from a conditional green card they just punch in the date that is about to expire and will make the DL expire similarly....indeed, if you apply at the "right time" DMV will have no idea as much as I keep getting every year jury duty service...

Hmmm....then I don't know...maybe this varies from state to state instead of being a federal law...I hear that it's a state law also whether one gets a DL when they are a non-immigrant visa, or whether they have a SSN, while other states are not that strict...maybe this is also differing from state to state of how one gets their DL when they have EAD card, or other immigration related documents...

I just re-entered the US: my green card expired on Dec 15th 2012 and I had my AOS with me; i left for the Holidays and flow back to the US yesterday at DFW airport in TX. The immigration officer sent me to the immigration room and explained that everytime i will re-enter the US until i get my 10 years GC, i will have to go in the immigration office in order to get approved and admitted.

I just wanted to let you all know that even if we have the AOS, we have to add extra time in order to travel / change plane..

Haven't been on VJ for quite a while. Hubby's temporary green card expired Dec 15, 2012. Can't remember our NOA1 date (think it was Sept 20 or so) and biometrics were on Oct 17. It is at VSC so expecting a long wait from what I am reading here.............

you've had your AOS with you?? Not sure what you mean. Do you mean the extension letter?? I've never had to go to the immigration office when I came back to the US with my expired green card and my extension letter.
