Hi all,

Is it okay for a USC to get an indian tourist visa to marry in india? The USC would return and not overstay or anything... and then would file I-130 when they get back. Any problem with this?

The marriage would be under the Hindu Marriage Act (no need to wait 30 days in India)

Yes, USC can get married in India on tourist visa. That is perfectly okay. USC can stay with spouse in India as well, and can extend the visa in India for any amount of time.

if you are American native (not an Indian descend) USC, then there is a risk on registering your marriage in some part of India. There was a thread in this section few weeks ago (you may need to dig old threads), where American USC married in northern part of India and having trouble to register their marriage for more than 3 or 4 months now.

But if you are Indian descend then you should be fine. I was in this category and traveled to India for marriage and got married in less than two weeks from the date of arrival. I was able to register a marriage with no issues. NOTE: Both me and my wife are Hindu.

I think you should be totally fine. IMO, you should still check with local marriage registrar office in India (city district in which you will marry to your spouse) for their requirements to register a marriage. As we all know govt is all corrupted and each office and officer have their own set of rules and philosophy to harass civilians. Prepare for the worst and hope for the best That's the way I deal my things in life.

no problem then, you should be ok.. I have done the same.

One thing - Go to US Embassy in Delhi, got the no objection certificate of American citizen married to Indian citizen....Embassy (American Citizen Services) know what to do. They have done this number of times.... This no objection certificate will help your spouse visa during immigration too.

Some to marriage registrars can also ask for it once you go and register your marriage.

The marriage registrar may say that you have to register under the "Special Marriage Act" as you are a foreign citizen. That means you need to stay in India for at least 30 days to get the marriage registered.

You should check this with the marriage registrar before you plan your trip.

Hi,I married my wife who is an american citizen in India,I got married in a temple,went to US Embassy got the no objection letter and later the very next day I registered our marriage through the registrar of our region ,I mean my place,no questions asked got the marriage certificate the same day ,after the marriage, went to Delhi filed I-130 got approved in a month and it was sent to Chennai got the interview date the very next month.

she said she is sikh. Special Marriage act only apply when the marriage is between Hindu and Christian or Hindu and Muslim or Muslim and Christian without the need for any party to change their religion.

Sikhs,Hindu,Jain and Buddist are all included in Hindu Marriage act. Thus they can marry each other and get it registered under Hindu Marriage act.

However the Registrar officer might still make a issue, Trust me he would only do this to get bribe or some gift. Good idea is to take a small gift like a little expensive wrist watch or perfume bottle or something else. Each officer is diffrent. Make your judgment based on his personality. And be a little discreate when giving the gift. I hate curroption but you have to deal with it to get things going in India.
