Applying for AOS while being out of country

Hello all,

In 2010 I got married with a US citizin on a K1-visa. End of 2010 I left to go back to Holland for personal and medical reasons.

Is it still possible for us to do AOS while me being in Holland?

If you left the US without your greencard or advanced parole, then you now need to apply for your IR-1/CR-1 visa.

If your time lines are corrent and you never adjusted status after marrying and before leaving you have to start all over with an application for an IR1 visa.

I remember you - we had a long talk about what to do. We told you then to apply for a spousal visa, and we warned you that there might be an overstay/ban problem to overcome.

No, not at all.

USCitizen spouse must now file an I-130, and once it's approved, you apply for an immigrant visa at the National Visa Center in the USA.
