Here I go again on the co-sponsorship topic...

I understand that I-134 is not legally binding while the I-864 is.

I also understand that the required form for the Affidavit of Support on the interview is the I-134.

But we are using a co-sponsor (my fiance's mother) so here comes the idea about the I-864 + I-864A.

Can it be that I present an I-134 from my fiance and another I-134 from his mom on the interview?

What do you think will happen if I present the I-864 + I-864A on the interview? Has anybody been approved doing this route?

Or should I just be safe using 2 I-134s from both my fiance and his mom?

Thank you so much!

As I said in an earlier post; to improve the odds of the embassy accepting a co-sponsor (which is iffy with a K-1) complete both the I-134 and the I-864 and hand them over together. Yes the embassy for sure wants the 134, but I think that with the (binding) 864 the CO may be more likely to approve a co-sponsor.

There was a couple within the last few months that were approved that did the 134 & 864 and turned them in together, they were K-1 and using a co-sponsor.

Hand over both forms together when they ask for the I-134

The I-864 does not apply for application to K-1 visa. Your fiance and his mother should use the I-134 AOS.

It may not apply but Manila is known for not accepting co-sponsors with the K-1 and adding the I-864 has been known to get them to approve a co-sponsor.

AOS around here means Adjustment of Status.... which happens later in the States. Ya I know you mean Affidavit of support, just that using it as AOS throws people off as they start thinking Adjustment of Status

Yeah....it threw me off in the beginning also....but many are using AOS for affidavit of Support. Usually I spell them out, especially if the OP is new.

You being an IR/CR -1 would be using the I-864 anyway. The IR/CR process I know very little about. Just the same knowing what I know now I would have went that route I think.

They both have pros and cons....but after weighing everything out, I felt more comfortable doing the IR-1/CR-1. People say the IR-1/CR-1 is cheaper, and for immigration purpases that is true. But I spent a lot on travel, stay, and wedding preps in Pinas. Also a big pro is that my wife will be an immediate LPR upon arrival in the USA.

It doesn't hurt to have both when presenting the I-864 too only shows future intentions and commitment in the AOS stage. I've thought of doing this as well even being the only sponsor.

No reason for the petitioner (alone) to do the I-864 now, it will have no affect on being approved. All you need to do is exceed the 864P guidelines and you are gold in regards to satisfying the embassy.

Hi guys! I have been informed by some that they used I-134 from the petitioner and another I-134 from the cosponsor and their interview went smoothly.

I think I will do that as well.

I will just have the I-864(cosponsor) on back up if ever the CO will demand to see it.

Thank you for your replies =]

I would turn them both in at the same time, the CO will not ask for the I-864, he/she will make her decision based upon evidence at hand... And then they may refuse to even look at the I-864.

Noted. I will do that as well. Thank you, Hank.
