NOA2 never received

Well I received my letter from the NVC and an e-mail from the USCIS stating that the fiance petition was approved, but i am POSITIVE I never received an actual letter from the USCIS. So i called and explained the situation to them and explained that I have to have this form in order for Eric to do his adjustment of status when he arrives. They told me I would have to fill out a request for a duplicate copy and pay a fee of $405!!!

I was like is there any way I can get one without paying the fee and they said no. So I said "So I have to pay $405 dollars for one piece of paper that I never received in the first place that I HAVE TO HAVE in order for my fiance to get his green card..." and the supervisor on the phone just said, "Yes." Ugh I'm so mad. Luckily I might be able to fill out the fee waiver form because I took 6 months off of work/school this year to go to the Ghana to be with Eric, so technically I will be under the income requirements. Has anyone had an experience with this or a similar situation? Thanks again.

NOA2 is not called that in their terms it is I-797. NVC does not usually send a letter saying anything to my knowledge so maybe that is your NOA2?

Welcome to the forum.

There are several isolated past threads talking about a similar situation. As I recall, one person was going to try to use a print-out of the email message from USCIS as a substitute Form I-797 (petition approval) for the AOS process. Not sure how it turned out. Others have paid the exorbitant fee to receive a duplicate Form I-797. Consider using the site's Google search function to access past threads.

Thanks for your replies guys! I ended up sending an e-mail to the USCIS service center I was assigned to, California. I included my receipt number, our names and DOBs and explained in the e-mail that I could not afford to pay for the replacement fee and did not feel it was fair as I had never received my NOA2 in the first place. 2 weeks later I got an e-mail back from the California Service Center stating that they were issuing me another one! Then I got 2 NOA2 letters on the same day!! So if anyone else has this issue, contact your service center ( I think you can only do that by mail).

It's good to have it in writing regardless. Some have called in saying they never received a receipt and had a new one sent.

Midge and Isi; NVC sends a letter to the petitioner saying the approved i129f has been forwarded to xx embassy. Some do not get the letter though. I also know that some have sent a copy of the NVC letter and a print out of the online status when submitting AOS if they couldn't find the NOA2 letter. But it does exist. I have one as well, besides the NOA2. :)

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)
