I've been calling the NVC to get my case number for several days. They still haven't received my petition. My NOA2 was sent to me June 22.

So I decided to call USCIS to see if/when they have mailed it to NVC. When I got on the line with USCIS, the nice lady informed me that K1 petitions are not sent to NVC, but instead directly to the embassy. This contradicts info I've seen here on visa journey, including the guides and K1 flowchart. Then she said it can take up to 30 days to reach the foreign embassy.

Has anyone else heard this? I'm confused!

K1 timeline

01/30/2012 - Sent I-129F

02/07/2012 - Received electronic NOA1

02/07/2012 - Check cashed

02/11/2012 - Received hard copy NOA1

06/22/2012 - Received electronic NOA2

06/28/2012 - Received hard copy NOA2

07/16/2012 - NVC received petition, case number assigned

07/17/2012 - NVC sent petition to Kiev

07/19/2012 - Embassy received petition.

08/09/2012 - Interview in Kiev

Unless something has changed, USCIS doesn't send approved petitions directly to the consulate. They send them to NVC. My NOA2 even specifically stated that the petition had been sent to NVC. I can't see how USCIS could send them directly to the consulate because NVC assigns the Department of State case number.

I believe that the USCIS person you spoke with was in error. Not surprising as that the USCIS is part of the Department of Homeland Security. The NVC and embassies/consulates are part of Department of State. Each of them are very large government bureaucracies, with defined purposes, as stated in the Immigration and Nationality Act of 1952 (INA). The USCIS person appears to be unaware, or is misinformed, of the function of the NVC in the K-1 visa process.

Take the opportunity to review the large number postings from folks that are lamenting the longer than normal wait times at all levels of these visa processes. It seems that all of us are at the mercy of the government's summer "lull."

I received my NOA2 on Jun 6, I waited a week until calling NVC, every day was the same answer “we haven’t received your petition” I continued to call every day, I called on July 2, same answer then on July 3 I was given my case number, I did some searching here on VJ and found the NVC’s DHL reference number, I found a shipment from NVC to Kiev on July 3, the shipment was received by the Embassy on July 5 , the Embassy says they haven’t received the petition yet …..So… I called the NVC today and was told the petition was sent to Ukraine on July 5, the operator couldn’t give me the waybill or tracking number but I believe the petition was the one received on the 5th….my point is….don’t believe everything you hear from the operators, there is really no way of knowing where your petition is with complete certainty …..Frustrating I know

I think K1 petitions are sent to NVC, but it doesn't stay there long because the actual visas are issued at the consulate. For CR1/IR1 visas I believe those are issued at NVC, which is the reason those stay there longer. Plus some other processing reasons...

USCIS does not assign the petition an embassy case number, only NVC does that. The petition has to pass through NVC to get the case number regardless of what USCIS says. It's out of their hands now.

NVC might have your petition but just not logged yet. Just like it it with USCIS when picking up mail, some things are still done manually.

I'd recommend looking into the country specifics from now on - it varies when it comes to how long it takes for embassy to receive the petition until you hear from them.
