Final divorce with pending I-751

Asked in Louisville, KY - 41 minutes

Iam confused and don't know what to do. One attorney told me we should withdraw your current petition and file a waiver petition , the other attorney told me you don't have to re file we just send to change your status to divorced But when I read online a bout similar cases when you just send the divorce decree to change status they ask u for interview and deny the joint pettion and ask you to re file again with a waiver. So please advise me should I withdraw it and file another one from now and save time ?

01/08/10 - Delivered to Chicago (per USPS delivery confirmation)

01/18/10 - Received NOA's in the mail!

01/19/10 - Touch on all applications!

01/20/10 - Biometrics notice received

01/29/10 - Case transferred to CSC!!

02/03/10 - Touch on I-485 (Case is now pending at CSC!)

02/05/10 - Biometrics appointment (DONE!)

02/08/10 - Touch on I-485 & I-765

02/23/10 - Touch on I-485!

02/24/10 - Touch on I-485!

03/12/10 - GC & EAD & AP approved !!! - GC & EAD card production ordered email

03/16/10 - AP received in mail!

03/20/10 - EAD received in mail!

03/20/10 - Green card received in mail!

If when you filed the I-751 you were living together and you are divorced now then YOU MUST WITHDRAW the pending I-751 and file the form I-751 waiver.You can just ask to CONVERT the joint I-751 in waiver if when you submitted the I-751 you were separated, but not divorced. There is a memorandum from USCIS stating about that. Google "I-751 filed prior termination of marriage-April 03,2009.
