thank you for your detailed reply!!! I appreciate!!

I just asked him and he said he is making 1500 or 1600 per month becoz it changes by hours! (includes disability) since that is a part time job.

Do you think we are qualified?

Or we should still let her mom to be a co-sponsor for us?

From what I've read here, it seems his mom would work-out better as a co-sponsor, the petitioners income is borderline!

Thank you for your reply.

Still waiting our package to arrive NVC.

However, I've read online of the Hong Kong consulate site about the checklist of the package 3:

((Immigrant visa applicants require an Affidavit of Support (Form I-864) with sponsors’ federal income tax return that was current when the I-864 was signed if the affidavit of support has not been submitted to the National Visa Center. Kvisa applicants should provide proof of self-supporting in the U.S. or a job offer for you or a letter from the petitioner’s employer. Form I‑134 (not Form I-864) executed by the petitioner and his/her federal income tax returns for the most recent tax year may be required when the consular officer deems useful.))

I'd like to confirm which form I should fill out? since everyone is telling me to fill in I-134 but it seems that I should do the I-864 instead? and What if the co-sponsor (mom of the USC) does not make $28812 yearly? My fiance is living alone, his mom is living with spouse and a daughter. So the household size should be 4 including me. Thank you very much for your help!

Oh thank you very much!

What if the co-sponsor (his mom) does not make $28812 yearly? (Houehold size 4)

Can combine the income with her spouse?

What form to fill out?

No. The I-134 can only have one co-sponsor. You need someone that makes enough for their own household size plus the beneficiary.

Thank you for your quick response.

In that case, since my finance is making 1500-1600 per month..is it better if we use him as my sponsor plus the asset he has? (money in the bank, a second car he owns, etc)

If he makes 125% of the poverty level or higher for his household size(you + him =2?) using his income plus assets, then no co-sponsor is needed. $1500 a month is $18k and only $912 short. $1600 is $19,200 and puts him over with no need for assets. Estimating his income by going between those 2 figures is $1550 and that is $18,600 for the year. That is only $312 short. If he has at least $2800 in savings, that should do it. Just have him send in evidence that documents all his income with a letter from employer and a few months worth of recent pay stubs, plus bank statements showing how much he has in his savings. If he wants to use the car, he needs to document ownership and current value, but if he has enough with his income and savings, no need to list the car too.

THANK YOU!! How did you calculate $2800?

Since half of his income is from the disability from the government? will we be OK? becoz it seems that we barely meet the poverty line. Also, Can i send him money to meet the requirement?

For assets you need 3 times the amount you are short. Being short $912 means you would need at least $2736 in assets. If he gets SSDI disability pay, that is counted as income.

No, you shouldn't send him money to meet the requirement. It might make the interviewing officer think you are paying him for a visa. However, if you have a good amount of savings on your own, you can contact the consulate you will interview at and ask if they would accept your savings combined with your fiance's for the financial sponsorship. Some consulates will allow self-sponsoring, but I would not count on it because it seems most do not.
