No last name on Passport

Hello,

I am in the middle of filing I-130 to get my wife from India. She does not have any last name (family name) on her passport. She only has a first name. Is that going to be an issue? Do I just leave the field of Last name as blank on the form?

Has any one had any issues when there is no last name?

Any help will be very much appreciated.

I dont believe its going to be an issue as long as it matches her name in birth certificate too not just the passport.

i also don't have a last name in my passport. while filing out i-129 i put my dad's last name so my interview letter came with last name too and my case is currently in the process of returning to USCIS. i don't want to scare you but i would recommend just keep the same name as mentioned on her passport.

Yeah, that's what I am going to do. I will just keep her last name blank for now, as that's how it is on her passport. The problem is that on some of her other documents such as driver's license, voters id, etc, she does have a last name. But those documents are not required right now with I-130. But this could definitely become an issue later on.

Anyone seen such cases?

all u need for this process is passport and birth certificate nothing else so make sure that the full name on forms matches what she has in passport and birth certificate. later on maybe she ll need international driver to be able to use it here and it depends on which state you are at some states wont even let u use international driver license

If you read the India consulate reviews, you will find multiple instances of people being asked to provide their voter ID and voting record. Not too often, but it has happened. I don't know how this will affect you, but you may want to contact VFS and have them ask the embassy if you'll need any supplemental proof such as whatever your wife provided that convinced the passport office they should issue a passport with one name even thought she appears to have an actual last name.

Since you're just getting started, why don't you ask your wife to renew her passport in her married name? You can still send across a copy of your wife's old passport along with the I-130 application, but when time comes to submit copies to VFS, you can submit copies of the new passport. That's what I did. All you've gotta do is submit a copy of the marriage certificate when she re-applies for a change in name.

you dont need to do anything _here is how you fill the I 130 correctly

Name : Fill in full name here that she will legally use in USA so hopefully this is the "first name and Last name"

Other names used: Here you fill in the first name only and any other name variations

Visa will be issued under first name and last name and Indian authorities dont have any issue when you go thru exit immigration at airport as long as first name on visa matches the first name on passport

This is generally my recommendation for names that don't exist too but for places like Indonesia where people often have only a single given name, I suggest typing "given name only" or use the dashes and hand print "given name only" on the forms so, it's clear.

Never heard of this in India. News to me.

Since you're just getting started, why don't you ask your wife to renew her passport in her married name? You can still send across a copy of your wife's old passport along with the I-130 application, but when time comes to submit copies to VFS, you can submit copies of the new passport. That's what I did. All you've gotta do is submit a copy of the marriage certificate when she re-applies for a change in name.

Since you are in initial stage and have ample time,you must consider addition of last name in Passport.I have a reason to believe this.

Don't know about other Passport offices, but when I, the beneficiary, went to apply for passport PCC at Chandigarh Passport office, I was told to include my spouse name first in the passport. According to them, if you are married , your passport must show your spouse name,than only you can apply for PCC or reissue.

I argued but officer explained it mandatory as I was unmarried when I got my passport and now my circumstances has changed(unmarried to married) my passport is not up to date.

I always thought, passport PCC is one day job,so I was relaxed and was waiting for NVC notification before I get my PCC done.And when NVC demanded paper, I came to know I have to apply for reissue and than PCC, this whole procedure took me 25 days or you can say I delayed my case by 25 days.

Since you have ample time, you must consider this step or check with your local passport office. I had other option to get PCC, to populate my martial status as "single " in PCC form but my conscience never allowed me to do so.

1) Can I still continue filling out I-130, and use only her first name in the application or are you recommending to get the name change in the passport first, and then fill out I-130 after that.

No, it will not cause a problem unless you fail to change the passport to match prior to the interview. The clean and easiest way to deal with the issue is to change the name in the passport to the name she will use going forward and do all future paperwork in that name.
