http://www.visajourney.com/content/k1guide says that, after receiving NOA2, the US citizen should send: "[...] all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy." Does this include the original passport (or birth certificate) that the US citizen copied as proof of residency, or is this only about proof-of-relationship documents and other such things?

The petitioner had to prove US citizenship, having met within the last two years and you both are free to marry for the I-129F to be approved. Now at the Embassy stage the beneficiary must show that this soon to be marriage is not to commit immigration fraud by using this visa to gain entry into the US when they might not have been able to given their home country's status. Given your flag is the UK, I will assume that is where the beneficiary is. Now you need to send evidence of an on going relationship--i.e. trips to see each other, chat logs, e-mails, phone records--all of that that pertains to an on going valid relationship in the eyes of the USCIS. So no, you do not need to send the birth certificate of the USC or the passport. It mainly boils down to teh police certificate, medical, and all the required forms to be properly filled out. We send all of our information in with the I-129F, that my now wife only took e-mails and phone records from petition submission to the interview date. We had very few photos of us together but losts of e-mails and phone records.

Good luck,

Dave

all the US citizen should send to the UK is the I-134 (sponsor and co-sponsor if needed) and supporting evidence like tax return, W2, letter of employment.... that is it. no original or copy of the passport, birth certificate or anything else from the USC is needed. the UK embassy do not even want to see proof of ongoing relationship.

If you are USC and have had a divorce... A photo-copy of divorce decree was ok for 129 application... however an original must be present at interview. This is the only exception I am aware of...?

Perhaps not, however items linked from UK specific travel.state.gov website go to the general requirements, which include this (and not a copy).

http://travel.state.gov/visa/immigrants/types/types_2994.html#6

Required Documentation

You, the foreign-citizen fiancé(e), (and eligible children applying for K-2 visas) will be required to bring the following forms and documents to the visa interview:

  • Two (2) Nonimmigrant Visa Applications, Form DS-156 (prepared in duplicate). NOTE: K-1/K-2 visa applicants should not fill in Form DS-160, Online Nonimmigrant Visa Application
  • One (1) Nonimmigrant Fiancé(e) Visa Application, Form DS-156K
  • One (1) Application For Immigrant Visa and Alien Registration, Form DS-230, Part I (You are not required to complete Part II.)

K Visa applicants applying at U.S. Consulate General Montreal and U.S. Consulate General Ciudad Juarez have different application form requirements. Review information on the U.S. Consulate General Montreal or U.S. Consulate General Ciudad Juarez website to learn which forms you must complete.

  • A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions)
  • Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor
  • Police certificates from your present country of residence and all countries where you have lived for 6 months or more since age 16 (Police certificates are also required for accompanying children age 16 or older)
  • Medical examination (vaccinations are optional, see below)
  • Evidence of financial support (Form I-134, Affidavit of Support, may be requested)
  • Two (2) 2x2 photographs. See the required photo format explained in Photograph Requirements
  • Evidence of relationship with your U.S. citizen fiancé(e)
  • Payment of fees, as explained below

Note: The Consular Officer may ask for additional information, such as photographs and other proof that the relationship with your U.S. citizen fiancé(e) is genuine. Documents in foreign languages, other than the language of the country in which the application takes place, should be translated. Applicants should take to the visa interview clear, legible photocopies of civil documents and translations, such as birth and divorce certificates. Original documents and translations will be returned.

i dont care how any other country does things... this is what the London embassy website which is specific to the UK says...

http://london.usembassy.gov/application_documents.html

Divorce Decree or Death Certificate: Applicants who have previously been married should be prepared to submit evidence of the termination of the marriage (i.e. divorce decree or death certificate). Original documents or certified copies are acceptable.

London does not want --

-copy of I-129F petition (they have the original on file)

-the NOA2 (they know you got approved)

-birth certificate of USC

-divorce decree of USC

-evidence of your relationship (no photos, Skype, love letters, Facebook pages,or travel to see each other)

London wants from the USC --

-An I-134 Affidavit of Support with proof of income. It doesn't have to be proven with a tax return.

Everything else at the interview is about the UKC and the UKC's original documents (plus photocopies of the ones they want back like birth certificate or divorce decrees).

It's been that way for the four years I've followed London and Dan has confirmed it's still the same as of his interview this week.

This is fascinating.

But it couldn't hurt to still bring this information along just in case, right?

You can haul as much as you want to the interview. All it will hurt is your back. You may be the first ever of thousands to need that info. We offer what we know about London interviews. It is your choice to believe us or not,and ultimately make your own decision
