i just got engaged to a brazilian citizen and we think the K3 visa is our best option. but we have some questions. and if K3 is not our best option, please let us know. she already has a tourist visa.

1. how long does it take to get the K3 visa after we get married (we think getting married in brazil is our best option)

2. once she is in the usa using the K3 visa, how long does it take to get the green card (permanent residency)

3. can she leave US to go back to brazil whenever she wants?

Hey if ya'll get married, all process take minimum 5 months to complete the USCIS path, than have the NVC( can take days or months to finish), and the K3 is not more avaliable! I was on the K3 path, but they approved both pettition I130 and I129F @ the same time... so the best option for ya'll is the CR-1 route... bcoz the IR-1 is for couple married more than 2 years ... Have many forum here ya'll can take a look...

And ya'll can try the K1 visa for fiance... in MY OPINION is more fast than CR-1...

I am brazilian and my husband is US citizen. So if ya'll have any question i will be glad to try to help.

thanks for the help! she has a tourist visa. do you think she can be in the usa while we are waiting for the CR-1 visa? we want to be together!

Tourist visa doesn't allow the person to stay in US until CR-1 is completed. It would be good for short term visit. Since she is considered as intended immigrant. She may get entry in USA. She would need to show strong ties that she would return to her home country. But be prepared that her entry may be denied also while her CR-1 application is under process.

Also according to my short experience here, I could notice it has been easier and faster to go with the k-1 route, the good things is that you will have time to think over about it!!! Best of luck!!!

Just to clairfy, it is when her authorized stay expires. She could have a tourist visa valid for 10 years, that does not authorize her to stay in the US for 10 years. She duration of stay is up to the CBP (as well as her entrance into the US)

Ok. So let me understand this. We want to be together in the united states after we get married in brazil. So, we are thinking that we get married in brazil and then she comes to united states with her tourist visa, which says she can only stay for 6 months. When she gets in usa we will start the CR visa process. It seems it will take 10 months for this type of visa. That means she will have to go back to brazil after her tourist visa expires in 6 months and then we will have to wait 4 months until she gets the CR visa and then we can be together again. When she gets the CR visa, does she also get a green card?

Yes, :yes: She will receive a green-card when her CR visa will be approved. Not before it!

The benefit of entering the US and immediately becoming a US Legal Permanent Resident (Green Card Holder) to many people is worth the additional small wait in time.

* You must have in mind that it is very important that she returns to Brazil before her tourist visa expires, or you will have a serious problem with USCIS!

Where do you go to find out where to file your I-129 paperwork? What is the best way to have a tourist visa approved to travel from Brazil? What tips does anyone have?

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
