This will be kind of long, so i'm sorry if it is TOO long, I just really need some advice. I'll try my best to keep it short, so i'll give out the basics, if there are any specific details you would like to know, just ask. I don't know what to do anymore!!! :help::help:

I have been married to my wife (beneficiary) for about 6 years now. We have been at this process for about 5 years, with no positive results. She has had 2 interviews at the embassy already, and has been denied TWICE. I have spent about 20grand already just on this. I went through this whole process WITH a lawyer, because I had no idea on how to do this stuff myself. I tried it first with the K-1 Visa (I-129F petition). In about 8 months she recieved her interview (I wasn't present at the interview), she was asked an array of questions (she got some of them wrong) and was denied. Then my lawyer suggested we get married, and try the IR-1 / CR-1 Spouse Visa Process, and we did. She got her second interview months later (not sure how many) and I flew down to DR to be present for that interview. We took all kinds of evidence, but again were denied. They even took me into a room, to have me sign a paper (which I believe was to have the marriage nullified or something) But I refused to sign anything, and we left. They also pointed out that they looked her up on facebook, and saw that she had no pictures of us together. Also stating that they believed that she was just trying to use me in order to be with her ex-husband (which is living here in the US) they didn't believe a woman like that would get with a person like me for honest purposes. The reason why they denied us was later relayed to us by mail aswell. It stated that they believed she was trying to use me and/or commit fraud, etc...

Yet, almost 3 years later, (after that last interview) we are still together and married. We don't know what to do, and I feel like my lawyer is just trying to keep his pockets flowing. He insist I try again, but that this time, he will fly over to DR with me, so that he can legally represent us. Reappealing the denial will cost alot, but it is nothing compared to what my lawyer is asking in return for his presence at the interview (6k) which he says, will cover his expenses in DR (Give me a break :blink: ) What should I do??????????????? :help::help:

Wow, sorry to hear about your struggle. The first denial wasn't surprising because for D.R, you have to be there with her, so that denial was pretty much automatic. D.R. is a high fraud country. Don't know how much good your lawyer could do going down there sounds like he wasn't giving good advice to begin with. Someone else will have to help with that, but you never said why you were denied the second time. They're not going to deny because of Facebook, it will more or less support the decision they've made. Without knowing more about your case, not much can be done.

Lawyer in the interview in the consulate??? First thing I hear that. Not sure if he even be allowed in. As there is really nothing a lawyer can do.

You really need to cover all the bases they accused you in before trying to reapply again. I am not sure how much time you are spending together, and what kind of evidence do you have to proof that this is a legit marriage. It is not uncommon for them to check social networking sites especially in the high fraud countries. May be you should have a better evidence that will proof to the CO your relationship.

The only thing to say about your lawyer, he is keeping his pocket full with your money, but there is really nothing much he can do. Besides filing the paperwork.

Read it again my friend, I did specify why they denied the second interview :( They believe she is trying to use me, to reunite with her ex-husband.

Yes, I know you said that, but officially what was the reason. There not going to just say that and tell you to leave. What did the letter of denial give as the reason? What made them think she was using you? It's more detailed than just "She is using you."

Yes, I know you said that, but officially what was the reason. There not going to just say that and tell you to leave. What did the letter of denial give as the reason? What made them think she was using you? It's more detailed than just "She is using you."

The basics are that since she was married before to her ex-husband (of which she had 3 kids with)they think that all "they" are trying to do, is get together (since he can't petition for her) because of past crimes and the fact the he is only a GC holder, not a USC. They believe it is a fraudulent marriage.

Ah, gotcha. Yeah, that's a tough one to get around. So it sounds like you need to prove that she is coming for you and not him. Is the ex-husband married to someone else here? Maybe he's with someone else here whom he has children with? Maybe trying to show he's moved on will help your case.

I feel like giving up :crying: and just moving to DR.... :crying: But DR is not very "wheelchair" friendly. It is difficult to get around.

You're right, it's not wheelchair friendly at all. I asked my wife what do they do about handicapped people getting around and she shrugged her shoulders.

U have to carefull with domincans. They are very envious people. I have hear stories of people calling upnthe embassy and reporting fraud on couples. Thats why i kept my process as private as possible. People only found out when i had visa in hand.

Timeline

Pretty much you have to convince the consulate that she is coming for you and not her ex with 3 of her kids!

It's going to be very hard since DR is high fraud and you are in a wheelchair. You can move there and/or have kids. What is her ex's timeline on how he + 3 kids got to the U.S. in relation to their divorce? Does her ex and kids live in your state?

The consulate thinks you are being scammed. I would just move there and put in a few years before trying again!
