I485 denied due to USCIS ERROR!!!

Please what can i do???? I think USCIS's officer that made a decision on my case did error!!! 12/6/11 I was asked to submit a joint sponsor which i did and they received the documents whithin a month,1/3/12 same day they sent another RFE requesting for my main petitioner's i-864's form n tax returns which they specifically said most recent (2010) but which i already included when i submitted the whole application but i didnt care and sent all again and they got it on 1/12/12. On 3/1/12 I received a denial letter from USCIS, reason stating i failed to submit a complete IRS tax return from my petitioner for the most recent tax year n which on d same letter said i submitted it when n they received 1/12/12. I was so weak and same time funny to me how this could big error happen!!!!!

Lots of folks get confused about what constitutes a complete tax return. It is all the forms and schedules plus any W3 and 1099 forms. Is that what you submitted? If not, it is YOUR error, not theirs.

I am sorry but pushbrk is right, you failed to submit all the tax documents (adjusted 1040, W2, schedules...) It is why TAX TRANSCRIPT is ultimate solution for supporting document of I-864. You can refile, and it hurts in this economy. Good luck to you.

Just to be clear, my statement included an "if". I don't know what they submitted for a tax return.

I believe Do-It-Yourself is not for your case anymore, you need help from an experienced attorney. Failure to read instruction and submit supporting documents makes everything more difficult. Good luck.

USCIS did not make any errors. You made the errors. W-2s alone are not a complete tax return. In fact, it is not a tax return at all. You screwed up.

Good luck with your motion to reconsider based on your mistakes. You may want to be prepared to refile in case the motion is denied.

I am sorry you are going through this. Unfortunately, as you have now learned you have made a huge error in your response to the RFE that was sent to you. It is imperative that you now understand exactly what a complete "tax return" is if you are choosing to appeal the decision, or reapply. While you can wait for a response from them regarding your appeal, I would suggest you order the tax transcripts for your sponsor/co-sponsors now if you are going to move forward.

It was also suggested you consult with an immigration attorney. If this is feasible you may want to consider this as an option, since you have already been denied.
