I-130 for wife but not sure about stepdaughter

Hi, I am an American citizen by birth. My wife is in her home country to go through the immigration process with my stepdaughter who is 17, she will be immigrating with my wife. I am not sure if I should file an I-130 for my stepdaughter or am I supposed to do an I-824 and then do an I-130 for her or just the I-824? I would appreciate any guidance.

Also, will I be doing an I-485 for them as well and if so, at what point?

File an I-130 for each of them, together in the same package. Assemble them as if they were separate and would stand alone, then put your wife's stack on top of the step daughter's stack and mail them together. I-824 is not part of a normal immigrant visa process.

You posted in the K3 visa forum but I assure you there is no K3 visa in your future. Follow the CR1 guide. The daughter will receive a CR2 visa. The process is the same with a little difference in the supporting documentation required. The I-130 instructions will tell what is needed for each petition.

dm559 - wow - seems a lot of confusion there, with what yer choosing to do.

each intending immigrant needs their own I-130 petition.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

if you have an approved I-130 on the wife, now is time to file an I-130 on the stepdaughter,

albeit request an expedite with a COVER letter in the new I-130 submittal.

I've outlined 'how to do'

over at http://www.visajourney.com/forums/topic/255138-k3-k4-visa-converted-to-cr-1-by-national-visa-center/page__p__3918125#entry3918125

ignore the China specific bits for NVC processing, though.

and Good Luck !

Does the OP really have an I-130 for spouse that was approved int 12 days, as indicated in their timeline?

Yes, and he uses the word "petitions" instead of petition. So, I don't get why he's now asking if he needed to file a petition for each immigrant.

Thank you for all the replies. I said petitions because there are multiples but I just wasn't sure about the I-824 but thank you for answering. And yes, my timeline is accurate.

You asked this question in your first post of the thread. "I am not sure if I should file an I-130 for my stepdaughter or am I supposed to do an I-824 and then do an I-130 for her or just the I-824? I would appreciate any guidance. " I now ask you a yes or no question. Did you file an I-130 for the stepdaughter already? Second question. Was the daughter's I-130 also approved?

The third question is, "If you already filed an I-130 for the stepdaughter, why did you ask if "you should file" what you already filed?"

Sorry, I not understand your original question.

Petitions, at this point, implies 2 or more I-130's.

An I-130 would/should be filed on the stepdaughter.

Exactly what did you file, on who/m, and when?

Sorry for the confusion. No my stepdaughters petition is the only one that has not been filed and since she was under 18 I wasn't sure if her I-130 is filed now or if there was a type of visa that allowed her to arrive with my wife to the US and then file her papers.

Again thank you for the replies. I'll be filing her I-130 today, thank you!

excellent! don't forget the expedite process when doing an I-130 submittal. IMO, is best to get er done WITH the submittal, not any stupid 'use a telephone' after you have NOA-1 in hand.
