Approved form I-130 sent back from State Dept to USCIS for further review

Timeline

After the approval of my form I-130, my case was sent to State Department, and now it's sent back to USCIS where it was originally filed, what is it that they require now?

However, I want to let you know that our wedding pics were not sent, could it be because of that? And my case never yet, reached the Embassy/Consulate.

Nobody but you would have a clue why the case was sent back to USCIS but I doubt it's because of missing wedding photos. The only time I've seen this happen, there was a misrepresentation of facts on the petition itself. The reason would be about some question as to eligibility for the benefit sought.

Facts are cheap...knowing how to use them is precious...

Guys, my case was re-sent to USCIS and received by them on the 2nd of Feb 2012. No RFE letter has been received by my wife as of yet. Any idea when she may get that. There's one thing which I'd like to add again, my approved form I-130 never sent to Embassy/Consulate, was sent to USCIS by Department of State. So I basically never even got an interview date with the CO. Is this normal that a form I-130 gets approved and goes for further review and when my wife called the uscis hotline, the said to check back after 180 days!!! So another 180 days from 2nd of Feb 2012?? Please, if anyone knows or has gone through the same issues, do let me know what timeline could I expect.

so - approved casefile went from USCIS to NVC (what you call the Department of State)

then

NVC bounced it back to USCIS, claiming something was missing; without assigning a casefile #, without doing document intake for IV and AOS.

if it's been more than 45 days since NVC bounced it back to USCIS,

have the USCitizen Petitioner call into USCIS, ask for an ISO, then ask the ISO what's going on.

Getting an ISO is important - the first human that answers the phone IS NOT AN ISO.

so - approved casefile went from USCIS to NVC (what you call the Department of State)

then

NVC bounced it back to USCIS, claiming something was missing; without assigning a casefile #, without doing document intake for IV and AOS.

if it's been more than 45 days since NVC bounced it back to USCIS,

have the USCitizen Petitioner call into USCIS, ask for an ISO, then ask the ISO what's going on.

Getting an ISO is important - the first human that answers the phone IS NOT AN ISO.

It's not clear to me whether the case was bounced by NVC or recalled by USCIS. When recalled, it's usually because of some discovery after approval. When bounced, could be something missing. I suspect recall rather than bounce though. Often NVC never even receives these cases, which explains why there's no new case number.

Spelling mistake in Form G325A, could that be a cause for DOS to send my approved I-130 back to USCIS?

I know for a fact that there is a mistake, however, my wife the petitioner still haven't received any letter from uscis yet. And also in the city instead of typing West Chicago I put Chicago only, would that matter?

Depends on what was misspelled and how badly. If say, you misspelled your former spouse's name by entering "NONE" that's a far different matter than misspelling the Company name of one of your employers. Misspelling your own or your spouse's name would definitely be a problem, meaning the preliminary background checks were done on the wrong person.

What was misspelled?

The only word misspelled was the name of my building where I currently reside, I put "Geen City" instead of "Green City" and as mentioned earlier, I put Chicago in the city of the petitioner instead of West Chicago. That's it. Hut there is a repetition of the same address in the form where I have put "Green City" correctly.

Thanks Darnell, I just wanted to ask, it's been 27 days and we haven't received anything from the USCIS, you reckon it's better to appoint an attorney?

I wouldn't until you hear something. You'll either here USCIS sent it back to NVC without anything from you, you'll get an RFE or you'll get a NOID. Depending on what's in the NOID, you may want to hire an attorney. An actual RFE is the least likely next step, in my experience.

I wouldn't until you hear something. You'll either here USCIS sent it back to NVC without anything from you, you'll get an RFE or you'll get a NOID. Depending on what's in the NOID, you may want to hire an attorney. An actual RFE is the least likely next step, in my experience.

What did you find out when you contacted an ISO at USCIS?

It hasn't been 45 days since NVC sent the case back to USCIS, so have not called yet. Or should I have my wife call regardless?
