Hi everyone,

I recently went to visit my boyfriend for 83 days under the visa waiver program and was denied entry based on the fact that I didn't have enough evidence to show that I had ties to my home country. My question is, when I was initially going through immigration and they asked me why I was coming to the US I said that I was visiting a friend, of course I then told them that it was a boyfriend when they questioned me more but on the paperwork that they gave me it says "Who did you say you were visiting initially to the officer?" to which my answer says a friend and then it says "Who are you visiting?" and it says my boyfriend. What I was wondering is, does the fact that I said friend and then later said boyfriend once I was taken into the room cause problems for immigrating to the US in the future? Any advice would be greatly appreciated.

Hi, I had a similar experience.

When I first started in my relationship with my Fiance on my first visit to the USA I was asked who I was visiting, I said a friend, they asked how I knew

this friend and when I explained the officer then said, 'so your boyfriend'. I said 'I guess so'. I hadn't been in a relationship for a long time and because it was

still new, I hadn't been comfortable saying boyfriend. I frequently get stopped for secondary screening at immigration in the US as I had previously lost my passport, which seems to result in your records being flagged and I get asked a lot of questions each time. But I am always completely honest so even thought there

is always a bit of a delay in getting through immigration, I have not been refused entry.

I have visited my Fiance 5 times in the last 2 years both before and after filing for a fiance visa and have made sure that I have what I have needed to show ties to the UK, and of couse, been completely honest. The original question about who are you visiting has not caused any problems. On my second visit to see my fiance (then my boyfriend), when I was asked who I was visiting I did not hesitate to say boyfriend. We were then much further along in our relationship so I was happy to say so.

I now have my K1 visa and will be travelling to be with my Fiance in February. We will be getting married in March.

Thank you for your response. It doesn't seem like it should be a problem for me it's not like I signed a form that said "I have lied to immigration" or anything like that. Congratulations on being able to be with your fiance properly! it must be so exciting.

Shouldn't be an issue. You were refused entry so it's not like you are going to attempt to adjust status from VWP or anything. Good luck on your future application!

Sorry to hear that. I personally don't think it will affect your future visit or immigration process. Just bring enough evidences next time.

May I ask how did the officer ask you to show ties to your home country? Did they just ask if you have anything to show that you were going back? also did you have a round ticket?

May I ask how did the officer ask you to show ties to your home country? Did they just ask if you have anything to show that you were going back? also did you have a round ticket?

Thank you for your response. He asked if I owned property which I don't and he asked if I had a job which I do but I didn't have any evidence of my job on me, I did offer to show them my bank statements online to show the company paying me but they weren't interested. I also showed them the fact that I am in University in England but apparently that wasn't enough either!. I did have a return ticket which I showed them, it just seemed as if they were determined to not let me in, I don't think there was much more I could have done besides choosing to go through immigration at a different airport or going through a different officer! lol.

Are you a full-time student? How did you show them that you are in University in England? Normally, a proof of full-time student should be sufficient. This worries me a little bit.

You said you were going to stay there for 86 days right? maybe they are questioning how you can stay away from school that long.

I showed them my assignment book that stated when I next had to be physically at my university to sit my exam which is in June, I think next time I go to visit it will be a much shorter visit first of all but I'm also going to get a letter from my tutor. Their main concern was that I was using the visa waiver program to live there. When I next decide to visit I will be bringing lots of documents because they refused to let me show them my bank statements online or even plead my case.

It is not clear whether or not you're aware that you are not eligible to travel under the VWP if you have once been refused admission to the United States (link). Next time you want to visit, you will have to apply for a visa in advance. Of course, presenting these types of documents would probably be advisable. Wish you best of luck!! :)

Yes I was told that I can't use the VWP anymore and that I will need a visitors visa to visit. Considering that they wouldn't let me get the documents I needed off my computer I think it would be a good idea to have them in paper form with me so they can see that I am indeed in University in England and I do also have a job not to mention my whole entire family is in England.

Has anyone else had to go through the refusal process? and doing the question and answer interview/form thing?

What kind of things do you think I would need? In terms of my job I don't make enough to pay taxes so I don't have any tax information but I can get a letter of employment, what would you suggest for proof of me going to University?.

My boyfriend has been amazing throughout this whole thing, his first reaction was to get everything situated so I can move there perm. He is of course upset and misses me but he's been very positive with concentrating on the steps needed to have a life together.

Any info on what would be needed for my tourist visa would be great, I know a decent amount about other visas but I'm a little fuzzy on the details for the tourist.
