Hi Everyone,

I have a pending family based AOS. I wanna bring my child here in the US. Can my USC husband file a petition for my child? He is not the father.

She is in my country. What is the fastest way we can do to get her and bring her here? What documents do we need to file? I have an upcoming interview on January. Will this be a problem? I mean do we have to file the petition before my AOS get approve? Will it cause longer processing time to get her if I got approved for a 2 yr green card? What is the best option? File before or after? Please help. Your advice will be appreciated very much! Thanks in advance! :)

Yes, if your USC Husband files and I-130 he can petition & sponsor her to come to the US.

The child's biological father will have to given written permission from her to immigrate to the US unless your from the Philippines and she was born out of wedlock.

Your I-485 has NO bearing, influence or documentation required on your USC husbands petition for his stepdaughter

Okay. Thank you for your reply. Do you know how long it will take to process her petition?
