I applied for VAWA in may 2011. They asked for RFE in June. I turned it in in August way ahead of the deadline in October. I got everything though. I think I sent the police and the restraining order a day later after I mailed the RFE out. Today (4th) of October I got a text on my phone. As I checked my USCIS account I notice that a negetive decision has bee made it say:

On November 4, 2011, we mailed you a denial decision notice for this case I360 PETITION FOR AMERASIAN, WIDOWER, OR SPECIAL IMMIGRANT. The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of November 4, 2011, please call customer service at 1-800-375-5283 for further assistance.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

What can I do now .... I really need help. I did not hire a lawyer for this case for lack of funds. I beseech someone kind to inform me on what this means. Thank.

Again, you're in a waiting game. You will have to wait on the notice to come in the mail to see what you were denied for. Based on what the denial is, you may have options to appeal the decision.

Again, you're in a waiting game. You will have to wait on the notice to come in the mail to see what you were denied for. Based on what the denial is, you may have options to appeal the decision.

Thanks a lot my daughter is a Canadian. Somehow I connect to you. I am glad you answered my question as I am so worried. I promised her (my daughter) that I will be up in Toronto December. I don't know I still have some fighting to do.

What do you do when you have a denial notice decision? Someone help me.

Wait for the denial notice.Once you have received it read through and understand why they did deny your petition.PLEASE DONT APPEAL "CAUTION" its rare that denial through appeal is overturned.The best that you can do I think you have 30 days re-apply and submit also the reason why they denied you in the first place I am sure which was supposed to be RFE.I know i-360 vawa petition is free so it wont cost you a thing and appeal is like $700 which like I said its rare to be overturned USCIS dont make mistakes on vawa denials.Best option is to reapply and many received approval after first denial ,all the best also go to the vawa forum you will receive a lot of help from people who went through what you have gone through as in "Denial"

I think it is response to my RFE. I got the police report and restraining order the next day after I sent the package in. I then sent the police report and the restraining order:They were sent away same day too. I guess they probably used that against me. In any case am just speculating. I can't do anything now but wait for the notice. I am so worried am not focusing with my school as I have EXAMS on Monday, 7th 2011. Is this notice thing NOID or is it the final decision from USCIS?

Did they send you an email to say they have DENIED your application or NOID? If its a NOID take a deep breath and relax a bit for its not denial but NOTICE OF INTENT DENY.Which means they are thinking of denying you the application due to lack of evidence they requested and maybe you didnt send or sent but wasnt convincing.

I got the text for update and then I went checking my uscis acount to see what they said above.

Can they send a denial without letting you know about your RFE first?

You have already asked this before. You have to wait to see what the letter that comes USPS says. Asking again doens't change the answer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What did the RFE ask for? And what did you send? You said you sent the police and restraining order separately, so separate them into the packets when explaining what you sent.

You are given ONE chance to reply to the RFE, if you fail to respond properly then you're denied. It may be sending the police stuff separately.

They asked me to resend everything:

Marital staus

Residence

Goood faith marriage

Battery or abuse.

I sent the restraining order, police report and car title just a day after. Note it was before the deadline. My reasoning was that if it is before the deadline I will be fine. And after the deadline it will be bad. I think that is what it was. Just speculating. It is hard to wait at this time. But why denial, should it be NOID then denial.

No. You're given ONE chance to successfully reply to an RFE. The second package was a SECOND package, and if it met up they might consider it but who knows. It appears that it's a straight denial and that they don't think you qualify for VAWA.

Only time will tell.

4.Ok this is the scoop 1. They said I could not prove I lived with my wife. (I did have paper work from welfare, drivers license, lease car title)

The problem is that I used a store address for school a year before I got married. I had the landlord at the business clarify that still it did not work.

5. They said that I did not prove battery. Well they got the restraining order tho.They did not say much about psychological effect. The police report was only a claim I made according to them. The police did not see any slap mark on me.

They said my affiants did not indicate to have seen anything done to me.

7. They assumed that the marriage was not in good faith but they did not give any reason.

I don't know how to begin here Please find the attachment I put up. I could not upload all of it. They have a global limit on here. Hopefully I will figure it out soon.I should not have sent the bill from school it was a mistake and they used it against me. So when can I start to refile? Refiling: it seems to be a better option. That way you can be correcting the error with a new officer.
