I got denied to re-entry to US because I took medicaid for my son. What to do?

Hi,

I came to USA on Jan 2010 and I got my baby son on May 2010. I took medicaid for my son while I was in US and studying. I had to go back to my home country, Bangladesh because I had to take an opportunity of faculty opening in my country. Because I went there for more than two semesters, my F1 visa got cancelled automatically. When I went to apply for US Visa again for reentry to US, they asked me about my son's inusrance. I said I took medicaid. Just after that they denied my visa. I applied two times but still they kept denying. Any idea of what I can do now? They have my denial information in their system--and I don't know how to get to US agian to continue my study. I already spent two semesters in US and now waiting to finish rest of the courses.

OP - did YOU receive medicade or your son?

If you received it then it is obvious why you are not being allowed entry into the US - there is a risk that you, again, will become a public charge. As well as the points that Jojo makes of having a USC child

Is it possible to pay back the medicaid? I am not sure if it is but that may help, as you would then have paid back what the US tax payer spent on you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If your son is a US citizen, then he is entitled to receive Medicaid.

You are not getting a denial on a new F1 because your son received Medicaid. You are getting a denial because a US citizen son makes it less likely that you don't have the intent to immigrate. Your ties to the US are now stronger than before.

It also is suspicious to some that you entered the US in Jan. 2010 and then had a baby in May 2010. Seems like you came to the US to give birth to have a US citizen child. Not too many women choose to come to the US alone on a student visa when they are pregnant. Most would probably not go the US so they can give birth in their home country surrounded by family rather than alone in the US.

Medicaid is not for your Son, the Medicaid you used during the child birth process is used by you not by the child.

If child was sick and medicaid paid for it then it is considered for USC kid.

Also it seems you were 5 months preg when you entered US and it seems that you only entered US to have Child in US.

All these putting togeather CO is not going accept your new argument that now you want to come to US to continue your study.

I think all are drawing their guns without much clarity. I am not even sure if the author of this post is a he or she? Also I couldn't figure out from this posting (pardon my ignorance) what was the exact purpose of using Medicaid? The submitted needs to be clear about those facts, also why he/she thinks that the denial is for such? However readers are just assuming IF. And portraying their expert opinion based on that if, so the submitted needs to be clear to get some decent and appropriate suggestions. At least the possibility would be higher.

Yes. As of now, your understanding and knowledge is correct in reality (unless it's from a movie), men still can't give birth. However, I carefully read her post again but could never even find the notation of "Gave birth", rather came across "got my baby son". That is one of the reason I thought this could be a He rather than a She. The other reason I am confused about the sexuality is because of the OPs screen name. Being from the same geographic locaiton, I know it's predominantly a male name. However, when it comes to a screen name of user ID, I've learned never to assume. And certainly I could be wrong.

Even if we assume OP is a guy that means he had got his wife on F4 visa and they had a baby.

He would be responsible for cost of hospital and medical treatment, US tax payers are not responsible for the cost.

Secondly even if we assume it was guy they knew his wife was 4-5 months preg when they entered and if they knew they could not afford inssurance in US they should had stayed in their home ocuntry and had kid before entering US.

Putting everything togeather it sounds like it was all planned to have an anchor baby in US.

Well no free meal in the US. Well you can wait til your son is 21 year old then you can continue studying in the US. Never late to study...
