Hello All,

Please bear with me, I am new to this. In fact this is my first of such....

My situation is a little different from others I have read here. So much so, that I am not sure where to post it. Since my early teenage years, I have resided in the U.S and have been for the last 11yrs. I went there with my dad and we were able to gain permanent resident. He now has his citizenship, while I relaxed on filing mine. Because I got in some problems with the law and was worried of the effect upon filing for citizenship. My last issue with the law was in 2006 of which after successfully completing all probation, community service etc, the offense was reduced to a Gross Misdemeanor. In April 2011, I was informed of a bench-warrant for my arrest because I didn't show up in court on a case I was fighting, concerning the suspension of my driver's license of which I was not notified. The case was set for a year out, and that contributed to my forgetfulness.

In April 2011, when I was arrested, I was waiting to post bail or go to court for a minor thing but then was informed that ICE (immigration&customs enforcement) had put a hold on me. Long story short, I was told my previous crimes threatened my status in the U.S. Although I had long turned my life for the better and was in school the last 5yrs with a couple degrees under my belt, the Judge failed to listen. I also had a money hungry lawyer and I had very little money so he barely worked for me. I was also informed by people that it did not matter if my crimes were from 30yrs ago. Which is very sad because I believe that people can be willing to change, and I very much so am. Anyway, I took what would come because I did not want to waste away behind bars.

I was deported in June 2011. With a condition not to return for 10yrs. My fiancee is trying to get me back, however we are been told a K1 visa does not apply in my situation. Is this true? We were told we would need an attorney. Is this also correct. I don't have money at the present. Its hard to get a job and the language is difficult for me to grab. I'm been told I must have my degrees accredited to my home country, which also requires money. The life here is not what I am used to and I would like to make something of myself but its proven tough. Please help me with any information possible. I and my fiancee are at a standstill, and she is losing hope. Please help me not lose my love. I am willing to open up about everything and be honest, as it will be for my own good. By the way my Permanent Residence expires in 2013.

Based on the situation you described you will need a really good immigration lawyer. From what you told your charge was reduced for Gross Misdemeanor, I would assume from Felony. ICE do have ability if they want to deport you based on your criminal charges, especially since you were not USC. So this caused your issues, it's just took them for awhile to get to you. You got a 10 year ban based on your criminal history, and there is a little chance you will be able to get a waiver for that, just due to the circumstances.

You are correct that you are not elligible for K-1,as well as you are not elligible for CR-1 since you've been (or still are) a permanent resident. You would need to get a lawyer that can contact USCIS on your behalf and find what is your current status. Most likely since you got deported they will cancel your GC as well. Lawyer will be able to tell you where you stand and is there anything that could be done.

What was the reason given for your deportation? What particular crimes? Different types of crimes have different consequences. A suspended license does not get someone deported.

It's not a surprise that the "money hungry lawyer" who "barely worked for" you if you don't have money to pay him. People don't work for free. Did you expect him to work for you if you don't pay him?

A fiancee is meaningless since she does not have a legal relationship with you that would allow her to file a waiver. A wife would have a legal relationship that may allow her to apply for a waiver for you. She needs to go to Nigeria to marry you before she can file any type of waiver for you.

If you were deported and received a 10-year ban, I'm pretty sure that your permanent residence has already 'expired.' Anyways, what was the crime that you committed that was reduced to a gross misdemeanor?

Also, I'm not a legal expert, but if you a warrant was issued for your arrest for not appearing in court, you are downplaying the seriousness of the 2011 case.

You sound like a friend of mine. Very same thing, very same amount of years here in the US, even same thing about his father getting citizenship and him not applying because of trouble with the law. He even had degrees, but he would never work, because his father spoiled him so badly. The judge got tired of giving him chances and just deported him back home. His problem was that he was addicted to drugs really bad and because he did not work he did what ever he could to get money. Rob, steal, even steal from his father. I wont say his name in case its who I think it is, Last I heard this person was Teaching and using his creditials there in Nigeria simply because his father is not around to support him. This guy is approximately 45 years old. If its you contact me via email.

When you're an alien, it doesn't matter when you committed a crime & you can face removal proceedings up until you become a citizen. Now that you have the 10 year ban, you're pretty skrewed. You can try to get an attorney but all I have to say is good luck..we will see you in ten years. :wow:

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

OP stated "the offense was reduced to a Gross Misdemeanor" the only way it could be reduced for that if you were facing felony charges and made an arraignment with the DA. However ICE will look at this differently. They will look at this from the point of the original crime and not what it was reduced to, especially since we are dealing with serious crime.

I am not sure if OP have any chances to get back to country for the next 10 years, and even after that, it will be really hard, as they will look at the prior what happened, and why ban was issued.
