I've been married for over 3 years now, and I also have a 2 years old son, I came here with a K1 visa but haven't filled for the AOS yet as we are tight in cash. Is anybody here have any experience in filling late? Will this be a problem when I eventually file, yours response means a lot.

Nothing bad will happen to you as long as you stay happily married.

If you happen to get in the middle of an ICE raid by being at the wrong place at the wrong time, you may be detained, but the judge will set you free because you are eligible to file for AoS.

Note: you will need to submit an I-130 ($420) with your I-485 ($1,070) when you finally file for Adjustment of Status, because after having been married for 3 years, you will file for AoS based on being the spouse of a U.S. citizen, just like somebody who adjusted from a student or visitor's visa would do it, not any longer based on the I-129F of the K-1 petition.

On the positive side you will get an unrestricted 10-year Green Card, instead of a conditional 2-year card, so you would not need to file for Removal of Conditions two years later.

Agreed with the above advice. Also, there is no reason for you to bother filing for AP as you have been out of status long enough to trigger a ban if you leave the country. Do not leave the country until you have a green card in hand.

10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
