AOS interview at Federal Plaza, NY-No decission

Yesterday we had our AOS interview in NY Federal plaza.

we reached at 7:30, our interview time was 8:15.This for me and my Son of 10 years old. My wife filed for petetion who is US citizen.(my son is from previous marriage).

The IO officer called us at 8:50, he is a Black American young guy.He opened the door and let us come in (me,my wife my son and our attorney).The IO is a stone faced, no reply to our hello and good morning.

He took us into his office and told to stand and he took the oath.

He start questioning, first ask our ID, Birth Certificates and passports (he asked all old and current passports). We handed him.

Then he ask for lease, he checked the lease and asked questions to my wife, how much the rent, how do you pay and when you moved in.

Then he asked me about did you file any other petitions ( I have before employment based, but the company got closed) I told him this.

He asked about my previous marriage, and divorced, and kids. when there birthdays and how many of them etc.how much i pay child support to my previous wife. all these questions to my wife.

he asked my wife how you met your husband.

he asked me about who witnessed my marriage.

He asked my son when you met your step mom, how often you visit her.

He asked my wife where my son goes to school, which school and who picked him.

He asked about my kids birthdays, when it was to my wife.

Then he asked my some 485 questions, YES or NO.

He asked for other documents, my attorney handed him. Then he said you guys need to wait in waiting room. Then he directed us to waiting room. He told my attorney to leave all the documents on the table,as he need to review.

All the time the IO was stone faced, no smile and no eye contact. As per my attorney and other people he is the worst officer in NY federal plaza, and he got promoted last year only.

We waited around 20 mints, he came back with a printed paper and called my name, me and my attorney went to window he handed a printed paper with a check mark, "we need to review your file and we can't make the decision right now, you will receive the decision in mail with in a 60 days." he handed our passports and our original lease, birth certificate etc.

He said if you don't receive the decission within a 60 days the come with info pass.

He write in the passport by hand "I-485 pendig review".

When I reached home I checked the albums he took our 4 photos, but he didn't ask us.

I am too much stressed, any body has this situation please let me know.

Don't worry about it. It only means that he does not have the authority to give you an immediate approval. The IO that I had told me upfront that she couldn't make the decisions. Also, they usually take photos from your album. You may be surprised like I did when I received my welcome letter just three days after the interview. If everything was intact then all should be well.

Thank you very much for giving me a hope.

I was following this website and forum since April 2011, when I started my process.

I forgot to mention, he kept our I-94 (Me and my Son).

I checked online and my status still shows "interview'.

Sounds like you passed with flying colors. From your story, it almost seems like the IO was disappointed you guys were so well prepared and knowledgable.

If you feel offended by he taking pictures without asking and his attitude, you could consider filing a conduct complaint after this is done.

The IO is a stone face and no impressions on his face. He even not smiled when talking to my 10 yr old son.

(This is out of record-Some body there said he is a gay- you know i don't wanna ofend anybody).

If you feel offended by he taking pictures without asking and his attitude, you could consider filing a conduct complaint after this is done.

No point in this. They can keep any evidence you hand to them unless you also give them a copy.

No point in this. They can keep any evidence you hand to them unless you also give them a copy.

I never said he broke any rules, but his conduct might be in serious question. Given the initiative from the White House after we lost the Olympics, the very distinct memos sent by the CIS Director recently, and the congressional probes into CIS's customer service and professionalism, these types of things are taken very, very seriously nowadays--especially since Obama took office.

Not all IO officers can or will make a decision on the spot. Ours didn't, we were told much the same as you, but we were approved about 10 days later.

I'm not sure where the idea of misconduct is coming from. It's very normal for an IO to take pictures from your album to keep as evidence, that's why you bring them: as evidence. Anything you give the IO to look at, it is at their discretion to keep as they see fit. Additionally, while some officers are super friendly and smiley, some aren't. It doesn't sound like he was outright rude. I'm also not sure what him being gay would have to do with anything at all.

I understand. Now I got some hope. I appropriate all you guys feed back and suggestions.

Good luck. I hope you get your approval soon. I know it's nerve-wracking to wait, especially when the IO wasn't particularly friendly and you can't gauge their reaction (ours was the same). If you haven't already, set up text notifications from USCIS so you will know immediately if anything changes.

Again, I never said he broke any rules. Professionalism is taken very seriously by USCIS and many other agencies (particularly CBP), and I personally would tell somebody about his professionalism and conduct.

You are a USCIS "customer" after all, and Congress has recently made it very clear that they take these types of things seriously.

Right, but per the original post, nothing he did was unprofessional. He was not jumping for joy and he rightfully kept pictures as evidence. IOs are not there to be your friends, they are there to do an interview.

Yeah the waiting is nerve-wracking,I did setup an email notifications from USCIS website.

Is any difference for email or text. please advise.

Wait and pray.

Email and text are the same. I signed up for both and the notifications always came within seconds of each other.

You are so right. He did nothing unprofessional. You gave her great advice. Her IO took her I94 just like the lady took mine. She asked me questions that made me wonder about her knowledge of the process, but I realized that she knew exactly how to conduct the interview. They are interviewing us to see if we "qualify". When I was asked questions on my former husband's (may he rest in peace) G325A, I thought she was silly. After thinking it through, I realize that she was trying to catch me in a lie (just in case I was not being truthful). When the interview was over she told me that she had to run it by her supervisor and that she could not give me an answer right away. She basically told me what the IO told her and she wrote in my passport the same thing that was written in hers. Within 3 working days I received by welcome to America letter. She just need to relax and not get overly anxious; it wil come. We are waiting to celebrate with her.
