I don't know what else was asked or what else was said he just told me they gave him a paper and he read it to me about the section 221 G. I was and am afraid it is a denial and if it is can or is there any thing we can do to fight this and win???

221g does not necesserily means a denial. It is bascially a document asking for more evidence of relationship or other documents.

Usually they writes a note advising why 221g was issued. Ask him to read that info to you.

Petitions/applications are returned for a variety of case specific reasons. Usually, returning a petition/application to the USCIS means that the embassy/consulate refuses to issue a visa to the beneficiary, but they do not have specific evidence to actually deny a visa application. So the next best thing to do is return the petition/application to the USCIS office where the petition was originally filed requesting further review. You can get your senator involved if that happens who ccan get you the specific answer why the petition was returned.

I understand your frustration, but put things in order. Now, you personally interview your fiance and write down verbatum everything asked and the answers while it is fresh. With time important facts can be lost. Do research about any possible red flags, age differences or religion, or previous marriages and divorces etc. Stay focused and gather more evidence that would stand up in any court(only an analogy). Take a breath while you wait for your case to be returned to USCIS. Once received, a congressional representative can contact the congressional unit at USCIS for further assistance. I know that this is a hard blow as I have been there.

I will say a special prayer for you with Ramadan approaching.

Best wishes.

Hello every one, I am sorry I am very new to this and all alone the way my fiance has helped me and worked with me to get him here with me. He went for his interview yesterday the man asked alot of questions but ended up giving him a paper Section 221 G and didn't give him a reason just told him that his package was being sent back to the USCIS for a decision to be made. My fiance seen others getting there passport stamped but they didn't do any with his? I am wondering does any one know any thing about this and why they did this? What maybe going on? I have called the embassy and the operator just turns me over to a ringing phone I did sent an email to them also asking why and what is going on but so far got nothing. If any one could please help??? If this is a denial is there any thing we can do can we refile? and if so should I use a lawyer? Or what is my next step?

Thanks to all who take the time to read this and big thanks to any one who can help us

I'm really sorry to hear this... Morocco is a difficult embassy from what I read...Pakistan is also difficult

It looks like they have sent your case back to USCIS because they are rejecting your case. USCIS can review it to see if it is a legitimate relationship etc and then resend for antoher interview but it CAN happen that USCIS also looks into it and rejects it as well. You have been denied actually at the embassy level. I'm not sure the process of wht to do next... there are others I know that have dealt with this and been successful when USCIS approves it again and resends to embassy but you need to find out WHY it was denied first.. and try to keep it at the embassy if possible instead of having it sent back to USCIS... sometimes they don't send them right away...

JimVaPhuong is an excellent resource in this area... he knows what to tell you to do but I do know you must first find out WHY the denial....

Sorry to hear that and I think it is a denial of the visa unless they mentioned any other thing. Now ASAP contact the Senators of your State and let them involve and force the embassy to review their decision, but I doubt this could happen. At least they will find you the reason that the embassy denied your fiancée’s visa. It might take a while to get any news from the USCIS. So you have to act quickly on the embassy to change their decision before they send it to USCIS. Otherwise you will end up filing another petition.

Good Luck
