k1 Fiance interview at Mumbai Consulate

My fiancé just had her K1 interview today. CO was convinced of our relationship and all of the other documented proof we submitted. But still she didn't get visa. Embassy officer had only one concern that is "why we didn't get married instead of getting engaged?" My fiancé did her best to convince that we are not married yet ( we are actually not ) and explained to her our reasons of not getting married since most of my family and friends lives in US, Dubai and London and they all prefer to come to US for the wedding than in India. After few more Q & A, CO said that she is convince of our relationship but she needs more proof that we are not married and only engaged. She issued her 221G, returned her passport asked for the guest list with details such as guest’s contact info, our relationship to them and asked her to submit this guest list to VFS Mumbai.

My question is…Do they really call the people on the guest list to verify? It seems very odd to me since the list is provided by us and we can always train people to say what we want them to say. And consulate people are smart enough to understand that. Then why ask for the list? I fail to understand the reasoning behind it.

At this point, although we don’t have the visa but we are not denied either. What do we make out of this situation? Should we be worried? How long does it take after submitting the proof ? Would there be another interview ? Really confused.

CO are highly trained people they ask such questions that if someone is lying to them then they will come to know .. jus submit the guest list n then wait if you are not married then they will find out and will give you the visa .

Appreciate your response and I respect your opinion..I and my fiancee agree that COs are highly trained people and they are just doing their job..but still I have never heard that CO would call somebody in India to check our relationship...we are ready with our list and she is going to submit it tomorrow..hoping for the best..

Please provide more details... your age... occupation...are you inter racial couples......so that I can suggest?

No we are not an inter-racial couple. I am 31 and my fiancee is 27 yrs old. So there are no red flags there..both of us holds a masters degree and work at an executive levels at our respective jobs...CO was not convinced that why we want to marry in US when her family lives there and my family lives in Dubai and US.

I guess CO is just forgetting the fact that how unsafe Mumbai has become and people can actually be reluctant to go there or have their functions arranged..

Anways I would really appreciate any help, comment or advice i could get at this point...

Then let me ask you...in your religion/custom is it a norm to get enagaged and not get amrried?

Anything which is not a norm the CO will be skeptical about it!!!

Good question..we did consider that as well before filing for the fiance visa.

NO its not a norm in our religion/custom. But at the same time not everyone is equally religious or traditional. Our families were ok even with us taking holidays together even though we were not married..as I said, different people follows tradition differently...

It seems that COs in India are just trained with this one rigid idea that its against the Indian tradition where two people can actually live together and they seem to evaluate everyone with the same yard stick not understanding the fact that how quickly the culture and traditions are changing in India..sorry if I feel like frustrated soul but its very nerve-wracking when after putting in so much time and effort, everything is depended on how one particular CO decides your fate based on his/her ideas and assumptions..

Hi,

i have seen many cases where they have asked for guest list.. but not necessarily they have called the people and asked .. asking for guest list is a more common thing at the Delhi embassy but i guess it is becoming common at the mumbai embassy as well .. i had also prepared a guest list when i went for the interview but they never asked me . my case is in AP for almost 43 days now .. my interview was good and at the end of the interview i was told by the CO that your visa has been approved and you will get the visa in a few days but then after 2 days i received a letter saying that my case is in AP and they will contact me when it is over and they don't require any documents from me .. when my attorney inquired they her that it is a mandatory process ( it is probably fbi name check ) so i am still waiting .

ok..I wont mind if they want to call and inquire..we have nothing to hide...I am just worried that how long they will take..they seem to move very slowly..being away from your loved ones is hard enough and then we have to go through this BS..anyways I wish you luck and will pray for you as well..

Read the consulate reviews for India...go back through several pages. I remember reading a review where a CO kept hounding the man that he should already be married at his age. She called his mother and asked to speak to his wife and the man's mother said her son is not married. The CO insisted he was married and demanded to speak to his wife.

I remember several other reviews where people in India were requested to provide guest lists and contact information but I can't recall if any of the guests were actually contacted.

I think they are just bothered about the nature of relationship...thank you for the assurance..

when you say security check, you meant for the USC petitioner or beneficiary ? I believe USCIS does the security check of the petitioner before approving the case and in case of beneficiary, they are submitting the police clearance certificate anyways so whose security check they do and what kind ? can you please elaborate more ??

Hi, First of all...security check in not the problem here....he was asked to submit documents...so if you guys work on why CO think that he or she should get married in india then there must be something in his case that alert CO that he or she is married ......even not engaged.....THERE MUST BE RED FLAG IN YOUR CASE...you can not find out it is different thing....work on why CO think like that....rather than teaching them what you are thinking....argument has no place in any US Consulate in world....put yourself in place of CO...then you will understand problem at hand can improve you chances next time.....please do tell us your religion and which state of india you belong to....one more thing.....IT ABSOLUTELY DOES NOT MATTER TO CONSULATE WHETHER YOU ARE PRESIDENT OF THIS WORLD OR MOST RICH PERSON IN THIS WORLD....for them everything is same.....so make no mistake of thinking that you both are working as an executive so CO will approve visa....best of luck..
