Ummmmmmmmm.................. less than 3 years has nothing to do with immigration - the standard is being convicted of a crime that COULD have resulted in a sentence of more than 1 year - literally 366 days - whether served or not. If your fiance has a conviction and jail time, you had better sort that out well before the interview.....

Yes the expungement can happen, but it takes a long time, whether he is eligible depends on the severity of the crime and the amount of time since it happened... and you must get it done before ever setting foot in the embassy.

Did you ever get the police cert from St. Mary?

YES! :dance: Took two freakin months but YES indeed, and I guess it's something that is new to certain police stations as they told me on the phone YES MA'AM YESSSS to the question about obtaining the police reports for foreign visas and not just local. :thumbs:

Timeline

My fiance just got his police certificate at black river police station in St. Elizabeth so he can get his passport. He got it the same day and didn't have to pay anything. Is this the same one you need for the interview? Or does he have to go to Kingston to receive the one there?

My fiance got his record from a local station, he just have to clarify foreign record or local record that he does need, then they can do it there locally and he can pick it up there also.it's something new so it did take him quite some time and we had nooo idea what was going on, but finally did get through!

Timeline

Expungement is regularly done in Jamaica, you just have to pay a lawyer lots of money, it's not something a layperson can do. Just as it would in the US, expungement makes it legal for you to say "no, you have not been arrested or convicted of a crime". Expungement is also done here in the states, although it usually only applies to lesser crimes.
