Hello everyone!

So I just finished watching Nat Geo's Locked Up Abroad Forbidden Love. Very interesting Philippine law: If your wife is impregnated by another man; technically, the baby belongs to you, the husband. DNA results, to prove paternity, are irrelevant in their courts of law.

I don't know...I suppose I'm on a different wavelength. But I think that is complete BS. Of course, I don't believe in extramarital relations. But a baby, born outside of marriage, belonging to someone who is NOT the father? This seems illogical, to me.

What do you all think of the issue?

We know that is no brainer however DNA does not exist yet at the time that law was conceived here in Phils. I guess it's about time our politicians here revise that law. All my female friends were quite surprise why the girl is not aware of The Family Code of the Philippines. Base on the story she's a graduate and came from a nice school here in PI.

Yes, that was harsh. There are so many laws now that the government needs to revise. I am one of the many who believes that divorce should be legalized here. But unlike most countries, I hope they can put some requirements so that people will not rush into marriage with the mentality that they can get divorced if the marriage didn't work. I am strongly embarrassed with the way this case was handled (especially showing the corrupt side of the people here) but at the same time, and this is just my OWN opinion, I strongly disagree on extramarital relations.

There are states in the U.S. that have the same law.

It's not a no-brainer law, every bill signed into law has been deliberated and studied upon carefully. The rationale behind the law is to protect the interest of the unborn/child, the law doesn't want the child to suffer the status of being an illegitimate child, as such is always frowned upon especially in Philippine setting, that's why the law creates this presumption that any baby born in a marriage is presumed to belong to that of the husband and the wife. The presumption is in favor of legitimacy not illegitimacy. This presumption, however is NEVER conclusive and irrebutable and may be overcome anytime by strong pieces of evidence to the contrary. And DNA evidence, contrary to what has been said here, is never irrelevant to Philippine courts disprove paternity. In fact, courts give high credence to DNA results to be conclusive as to paternity. There is no need to revise the family code as regards the matter, as i have said one can always disprove the alleged paternity. The absence of DNA Evidence at the time of the enactment of the Family code nothwithstanding, the presumption may be rebutted by other pieces of evidence which the family codes also provided for.

Let's not looked down upon the girl or the fact that she graduated in a good school in the Philippines yet committed the mistake. To err is human. Not every Filipina knows about all the 257 articles of the Family code, that's a hard thing to do. LOL! PEACE OUT!

in the state of louisiana the law states" the husband of the mother is automatically considered the father of the child"

but to get arrested???? to have police barge into to a home with machine guns?? lets get a life!!!!half of the country and all the philippine politicians are all a joke.

i really hope they catch up to the rest of the world soon.

I began to watch it last night because its one of my favorites. However being so closely connected to the philippines through marriage i could not stomach to watch it. I could not believe how ignorant and out dated a country could be. To have the PNP storm a home with machine guns for a civil matter is rediculous to say the least. Thats exactly what it was a CIVIL matter!!!! There was no murder, no drugs, no embezzelment, no theft of any kind. But HEY what are you going to do????

On the flip side of this matter, what the hell was this guy thinking????? Banging some guys wife in the same home town???? what an idiot.

whats really funny about most of the police in the phils, is that without the M16 or AK they truly are cowards. once they strap on then they are the kings of the town.

Are you kidding me???? There is currently a population growth crisis currently in the Phils.

No one cares about the legitimacy of their children anymore. The mothers nor the fathers are concerned with this issue.

Philippine official claim that if this population growth is not controlled soon they will not be able to feed all the people

in the next 20 years.

80% of the children being born in the phils is currently by unwed mothers.

Now for my opinion of what needs to be done.

Regulate the control of the Catholic Church in the Phils!!!!!!!!!!!!!!!!!!!!

The Catholic Church does not allow Divorce and so says the Philippine Law.

If this couple was allowed divorce then this episode of locked up abroad would have never existed.

Freely distribute birth control Pills!!!!!!!!!!!!!!!!!!!!!!!!!!

The Catholic Church is against it!!!!!!!!!!!!

There are so many other Catholic rules that have been converted to Philippine Law.

For one thing to be considered illegitimate, there should be set of law/laws or rule/rules that allows or disallows/prohibits such thing, now from what accepted standards/rules/laws did you based yours that you considered my post as illegitimate?

You read the post of the Lady from PI, so you know what i said Re: looking down upon the woman. The fact that the the accused lady graduated from a good school in the Phils and that she doesn't know the FC is totally uncalled for. Whether one graduated or not, the possibility of committing a mistake is likely to happen to anyone.

Do you even know a thing about the FC of the Philippines for you to say that, you're statements are clearly without a doubt, merely based on opinions without legal basis at all. Obviously, you lack knowledge about the family law in the Philippines. I beg to disagree but the state cares about the legitimacy of the babies, otw, there should have been no family laws at all. I mentioned about the legitimacy not the population. Legitimacy is one thing, and population is another. The pivotal issue in this case is the "no-brainer" of the FC as regards the presumption of legitimacy of the child NOT the population that you are talking about. And suddenly you even want to address divorce? It would really help you if you find some time to understand the FC. Don't you think you need to address the issue squarely? Just a suggestion.

Now for you suggestion, don't you think you should address that to the Philippine congress? just a thought so your "opinions" will make a difference.

Hey Markie!

I was watching it with my husband last night. It is ridiculous if you think about it. But you have to remember that she is still married to her husband and carries his name, so the kid even if he's not the father will carry his last name because that's the last name the girl is using.

It is not easy to know all the legalities pertinent to ones situation but at least know the basics. Like they say ignorance of the law excuses no one. In the Philippines her case was pretty much straight forward with the pregnancy being the evidence. To me her story all boils down to ignorance. Had she immediately consulted a competent lawyer upon receiving the summons they might have avoided it. In the Philippines the justice system is slower than a turtle's speed but money talks and when it does it goes a long way.

Also, for as long as the Philippine congress and the senate are populated with chauvinistic and narcissistic politicians there is no way Divorce will be legalize (what will happen to their ego and machismo that's boosted by the number of mistresses they keep) and add to that the ever meddlesome bishops, cardinals and priests.

i merely informed you that the population is being flooded by children of unwed single parents. that in itself is a no brainer.

in society children are considered illegitimate if born outside of a married mother and father. so in societies eye the population is being flooded by illegitimate children. so tell me exactly where and when does this coveted FC come in and help the situation??????? ahhh you see it doesnt.
