Hi everyone,

I recently got married to US citizen spouse. Currently I am in OPT.I am about to file my green card.

I found from the site that ,My spouse need to file the form I-864. But my spouse don't have enough income to sponsor me.

Now the my question is, If I use joint sponsor than what are the forms , joint sponsor have to fill.

A joint sponsor has to fill in a 1864a and your your spouse a 864

Divorced !st November 2012.

Married only 2 years 1 month

This is incorrect (sorry Barbara).

A joint sponsor will also file a I-864. If your joint sponsor lives with you, and you want to combine their income with your wife's for a household total, THEN they would file a I-864a. Only in that circumstance.

A joint sponsor will also file a I-864. If your joint sponsor lives with you, and you want to combine their income with your wife's for a household total, THEN they would file a I-864a. Only in that circumstance.

Sorry that Im just jumping in your conversation,but I have a question about this subject.My husbands income alone is not enough and so we are using my mother-in-law's income(she lives with us)she files I 864a,but does her income has to qualify on her own,or it is added to my husband's income and the total amount has to be sufficient to qualify? Can you please make it clear for me,thanks a lot.

It's a bit of the dreaded "it depends" answer. Is she living with you in your home, or are you living in her home? If her home, what is her household size? Is the income shortfall that your MIL would be making up large or relatively small?

we are staying in her home-household size 4(her,my 2 little brothers-in-law and my father-in-law).my husbands annual income is about $1000 below the poverty line what a bummer huh

ok so I read the I864a instructions again and I came across this:

"Form I-864A may only be used when a sponsor's income and

assets do not meet the income requirements of Form I-864 and

the qualifying household member chooses to combine his or

her resources with the income and/or assets of a sponsor to

meet the requirements."

does this mean that even if the household member, helping us, has a lower income than the 125% poverty line can just add their income to my husbands to qualify ..can somebody confirm this please..
