'hi guys, I'm finishing my AOS package but Im still a little confused with the I 864..

My husband will be my main sponsor but his income alone isnt enough,so we have his mom helping to meet the requirements...

my question is in this case will she be a join sponsor or a co-sponsor..?shes not from the same household so she cant fill I864A..

that means she can be s joint sponsor?? i dont know what the difference between a co-sponsor and a joint sponsor...

as far as i understood the instructions- they say that you can use a join sponsor if your income isnt enough and you are sponsoring more than 1 immigrant...??

anyone with an advice on that??

thanks

These words all basically mean the same thing. Your husband is the main sponsor. Your mother in law will check that she is the only joint sponsor.

guys I have to ask one more thing here, along with the I 864 we are sending info on our tax returns(3 prior yrs);

1.do we have to send transcripts from the IRS(i just ordered them) or just photocopies from our personal records???we do our own taxes with turbotax and so we have everything on file..

2.question 25 on the I 864:

"..25. Federal income tax return information.

I have filed a Federal tax return for each of the three most recent tax years....My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent three years was:...."

now being that my husband and I have filed our taxes jointly,on the tax return papers the total amount includes his and mine wages.but on the I 864 should it be only his income since hes my sponsor...Im confused,do I have to divide his from mine income and put only his in the space "My total income reported on my Fed tax returns".. or do I put the whole amount listed on the tax return papers??

and if I put the whole amount(mines+his income) do I have to include that on the I864 as income from the intending immigrant?? Im currently not working but I have worked before and we have filed a joint tax return every year..

I hope I was clear enough with my questions ...Im just overwhelmed with all this as Im trying to prepare everything 'by the book' ...

thanks guys..

Separate out your husband's income. You need to send a complete tax return, which includes W2's, any 1099s you may have, and any schedules (Schedule A, etc). Every person's complete tax return is different. If you are confident you have all the parts, then that is fine.

Your mother-in-law, as the co-sponsor, needs to qualify on her own by the way - I hope you are not planning to simply add her income to your husband's. Good luck.

no I wasn't going to just add her income, she is filling out her own I864 therefore like you said she's qualifying on her own...

so you say separate his incomes from mines for all 3 prior years right? but then it'll show a difference between the tax transcripts amount and the amount I put for him on the I864!!..oh my...this is confusing...I know Im getting a rfe on this form..I cant quite get how to fill it our correctly..

thanks anyways harpa

No, a sponsor doesn't need to list assets unless they need the assets to help them qualify. If they could qualify with the assets then they wouldn't need a joint sponsor. If they still don't qualify, even with the assets, then there's no point listing them since they'll need a joint sponsor anyway.

You mentioned a joint tax return. Is your income from a job in the US? Are you still working at this job? If your income will continue from the same source then you can combine income with your husband on his affidavit of support.

Your Mother-in-law will be the only joint sponsor. Co-sponsor needs to live in the same residency with the main sponsor. If she and your husband live in diffrent address, then she will file as a joint sponsor.

A co-sponsor does NOT have to live in the same residency as the main sponsor. You are thinking of a household member which is something different.

You both file an I-864. You check the box that says you're the primary sponsor, and your mother will check the box that says she's the only joint sponsor.

The Whole conversation made me confuse.

My situation is my spouse is US citizen.we both in the US. But She don't have enough income to sponsor me, so My father in law is helping me to file.

Now I know that my spouse have to file I-864 . what about my father in law?

My package is ready and I thought my father in law have to file I-864A and I was suppose to mail it today but I just read this forum. Can anyone please clarify it in my case?

Thanks
