COngrats! No one should have to wait more than a year like me! The soonest it can possibly be done is 2-3 more months making a short 16 months wait for US. Every month the government costs me hundreds of dollars by keeping us separated. What a joke!

Three things.

First, I would like to thank each and every one of you for your congratulations and well wishes. I hope that all of you get your approvals as soon as possible. This wait has been by far the most difficult thing I have done in my entire life. I can not imagine having to go longer than 5 months. I don't know how some of you manage it.

Second, I am not sure if my requests to my Senator and Representative were what helped my petition. I received a letter from DHS USCIS today that indicated that a service request had been started on March 2nd and that my petition was currently being adjudicated. That means that when I called, one week before my 5 months and requested that a service request be started, one was started. The Tier 2 ISO said that she could over-ride the less than 5 month requirement and it appears that she did do that. I am very surprised by this. I did not expect it to actually happen. I was very cordial with her and also let her know that I was aware that January and February petitions had been approved. I thanked her for her time. One odd thing on the service request letter is that they list my case type as I-130 and not I-129F.

Third, I have not heard back from my Senator or Representative yet. That is not to say that it might not have been helpful in my situation. I will include the text I sent them for those who want to pursue contact with their Congressperson. If you do, don't forget to go to your Congresspersons website and download and fill our their Privacy Act Consent Form. It will be required for them to assist you on any matter. Feel free to adjust it to your needs.

RE: USCIS Petition Filing

Dear Senator or Representative (name):

On (date of NOA-1), the United States Citizenship and Immigration Service - California Service Center accepted my petition (I-129F, Petition for Alien Fiancée). The USCIS says that they have a goal of adjudicating petitions within 5 months of receipt. I have now exceeded the 5 month mark and still there has been no activity on my petition.

My USCIS petition receipt number is WACxxxxxxxxxx. I have included a completed and signed Privacy Act Consent Form so that you may look into this matter for me.

I would appreciate any assistance you can give me in finding out the status of my petition. Also, any help in having my petition adjudicated in a timely manner is also appreciated.

On a related note, and I am not sure if you have any authority in this area, it has been noticed that USCIS routinely adjudicates and approves petitions that have only been in their system for a very short time (2-4 weeks). This happens while older petitions go untouched. It seems that there needs to be some oversight into the order in which petitions are processed.

I want to thank you for taking time out of your busy schedule to look into my USCIS petition that will allow my fiancée to apply for a K-1 visa. I truly hope that this matter can be resolved in a timely manner. Thank you.

Sincerely,

Your full name

Mesa, AZ

Again, thank you to everyone. I know that my journey is not yet over and I will be asking for more of your assistance as I continue.

Hi,

Congrats first! So happy to see one more case from Oct has been approved. I have the same time period as yours but I haven't seen any update on my case. I just called USCIS and talked to a tier 2 rep. I was told that they are still working on my case and I need to call back within 3 weeks if no update. The average processing time is from 5 months to 6 months now. I was thinking about writing to my Senator and Representative. I wonder if you could share what you wrote to your Senator and Representative. Also, did you fax to both of your Senator and Representative?

BTW, I am a new member to this forum and I don't know if we can communicate through emails directly. Please advise.

Thanks for your help and I appreciate that.

I guess you posted your letter already while I was replying to you...anyway, I got your letter to your Senator and Representative. But I would like to ask you if you faxed to both of your Senator and Representative.

Thanks again!

Yes, I faxed to both. You need to go to each of their websites and download their Privacy Act Consent forms. They will be different for each one. Fax this completed and signed form with your request.

In my case, my petition was already being adjudicated and approved on the day I faxed them ( I didn't know this at the time). I hope that it get your petition approved in a timely manner.

Hi,

One more question. I am new here so please forgive me if this question has been asked. I would like to know how I can find out when the NVC has received my case, when my case left NVC, and when the Consulate received it. By calling them with the receipt number?

Thanks!

Yes, Use your NOA2 Receipt Number and Call this number 1-603-334-0700 speak with an operator, They will ask you for your receipt Number, Beneficaries Name and date of birth, Petitioner's name and date of birth . You can ask if they have received your case and they will tell you if it's there or if they have sent it out to the embassy. I called 6 times in the 2 weeks they had our papers. They're very nice operator's. Good Luck To You :)
